It also states on the top page 1 of 2
They have not sent me any statements or any further info - just what is on here.
There enclosed letter says
Further to your request for a copy agreement in respect of the above account, we now enclose that document for your immediate attention.
We need to hear from you with your proposals for settlement of your account, which is long overdue for payment, within 7 days.
What do I do?
I know they haven't supplied it within the stipulated time but as they have still supplied it I know it is enforceable.
I have no statements or even page 2 of the document - I don't know what would be on that.
The credit limit also states £250 and my outstanding balance on recent letter from RW is £1408.20 - if they cannot provide any statements can I argue that I cannot owe that amount as it is over the agreed credit limit?
I don't know, I suppose I am just clutching at straws now as I really didn't think I would have to pay this off to them as they have taken months to respond.
Any advice please.

Hmmm that's a tricky one as why didn't they supply it in the first place and within the time frame? Do you remember signing it?
Hopefully someone more helpful will be along soon..Total 'Failed Business' Debt £29,043

Unfortunately yes, I know it is my sig on the form so I know I cannot get out of it on that count.
What I object to is all the interest which was added to the account which I have no idea how much it is as I have no statements and they haven't sent me any.
I don't know if I can play on the credit limit part - where it states £250.
I probably should still report them for failing to provide it within the stipulated time.

Upon reading another thread I am unsure as to whether this is the CCA or an application form?
It says in the siggy box " this is a credit agreement regulated by the consumer credit act 1974. Sign only if you want to be legally bound by its terms"
So is this an application form or a true CCA?
I am so confused

It should be a signed copy I believe with your signature.0

Funny thing is they have stamped it as recieved on 23rd Jan 2008 but it has taken them until today to send it?
Also on their letter they have dated it 04/02/08 which is today - the must have posted it on Friday (just checked and it was 2nd class post - but not dated - must have been franked mail)which was the 1st not the 4th. How strange, they also sent it in a different envelope to usual - they normally send it with their name all over it - this time it was a plain white envelope with no advertising on it.0 -
Seems like they are not sure what to do at all.
I don't have much experience as the time I asked for one I got a reply to say they could not supply it and it sort of died a death.
I know a few more people on here know a lot more than I do so hopefully they will find this topic!0 -
I have sent emails to the Financial Ombudsman and to the OFT regarding Robinson Way and the fact that they failed to provide the documentation in the required time.0

Well it does have my signature in the box but it is only page 1 of 2 - so where is the other page and what information is on that page?
It also clearly states that I have a credit limit of £250 and monthly payments of £10 - if they cannot provide any statements, how can they ptove I owe more than £250?0 -
From what I can remember this piece of paper which they have sent in is a copy of what I signed on the premesis in Comet way back when I bought my tumble dryer from them.
In those days they would get you to take something out on 0% and get one of their Timecards which is what I did (I was young and naieve) so would that make it an application form or not? - they would have phoned for authorisation of the account and it would have been approved there and then. I don't remember getting any other paper from them but I remember getting a Timecard - which should of had the relevant info with it but as it was 12 yrs ago I cannot rememberwhat came with it.0
