Hi Everyone,
I used to read these forums a while ago, but not this section as I didn't think it applied to me....(How wrong was i) It's started to hit the fan/I'm pulling my head out of the sand and i really need some advice.
I'm 25, and still live at home with my father. I didn't plan to still be living here at this age, and last year I was preparing everything so I could move out this year. I have the same amount of debt now as I did back then, roughly 10k. I had always been a bit lax at paying my debts, and one day for some reason I decided to stick my head in the sand and carry on living my life without paying them. Silly I know, but we all make mistakes. Sadly, last year my mother lost her battle with cancer and I kinda went off the rails for a bit. I lost my driving liscence and I didn't work, I had no income coming in and just kinda dealt with it. About 6months later I was just turning my life around and decided to go out with some mates. I ended up getting assulted that night and along with dislocating my ankle, i broke my leg in 3 places, which reqiured surgery and a lengthy rest in bed. As a result, I cannot do manual work for extended periods and this is cutting my income off. In the last 4 weeks I have been working casually at a removals company but due to my leg, I can only manage a couple of days before it swells up again. This is not alot to live on, let alone pay my debts.
One of my other issues is that my father is moving away in a couple of months, and I am going to be moving out somewhere with my girlfriend, and although I hope to somehow get the money to pay rent/bills/etc, i think i'm going to be screwed when it comes to my debts. Especially as I have received a letter from the county court threatening judgement.
What do I do?
Today I went to the court to inquire about bankruptcy and I have the forms, but do you think it is worth doing that in my situation? I'm going to find it hard enough to find the near on £500 fee that the court require, let alone paying everything else back ONTOP of moving out. I have no assets of any value and as i see it, no way out.
ANY advice would be good advice at the moment.

The first thing is post your soa (see post at the top of the page) na dpeople can help you cut back but from your comments I thnk a spendng diary is the first thing to start! You need to look at where your money is actually going. I'm not sure from the post how you got into debt?
Second is to think about a regular job that you can do and from the look f it a chang of directin would be in order. What about supermarket etc locally? Have you been to the job centre to enquire about work?
You need to deal with these debt rather than just pretending they dont exisit! I know that sounds harsh but you really need to deal with this before you get to the stage where bailiffs are knocking the door...Have you rung one of the rfee debt agencies for advice about this? You may be able to set up a debt management plan but you need to act now before things get out of your control.

Hi Rob, just to second what fishface said and add that these problems are rarely as impossible to solve as they seem. This post has all of the information you need as a newbie, including how to put an SOA together:

If you have had a letter from the county court, follow its instructions and try and negotiate repayments of a few quid each week BEFORE a judgement is made against you.
Once you have your SOA stick it online and we will take a look at it for you.0 -

You have had a great deal to contend with its not surprising you have found it hard to get through it.

The most important thing to do and quickly is get advice from Your local CAB Office and ask to speak to a 'money advisor'.*** The Consumer Credit Counselling Service (CCCS) - Tel: 0800 138 1111 *** National Debtline - Tel: 0800 808 4000 *** Payplan - Tel: 0800 917 7823 These people will advise you for free and without judgment.
Silvercharming & Fishface are correct in saying a spending diary and SOA will make things clearer.Once you can see were your money is coming from & going to you can begin to deal with things but good advice is essential please please use the charities above and quickly so you can begin to see light at the end of the tunnle.

Concerning the bankruptcy fee, i believe it is now means tested. ( http://www.debtquestions.co.uk/debt_forum/viewtopic.php?t=20870) I got off paying the £150 court fee because of a low wage, so only (only!!) had to find the £335. Some companies (water board is one) have a trust fund and they may be able to help you. There is a list somewhere on the bankruptcy board about this. Its also not considered unacceptable to take this money from your credit card if thats the only way you can pay it!
If you need more advice on BR and its implications, pop over to the bankruptcy board and the good people there will help you, should that be the route you decide to take.

Sorry you are having such a hard time but have you thought of claiming DLA?
You obviously can not hold a regular job due to your injuries so this may be worth looking into, mind i am no expert!!! Also if you have other people doing things for you this could help your claim.
I had to find the fees for my BR but i have a OH who earns an ok wage and i just stopped paying the Mortgage ect but you do not have this option. This is not an easy option ( as i have 2 kids also) and i can not reccomend the same but if you speak to your local CAB or even PAyplan they will advise what avanues are open to you.
