*URGENT* Please help, i think i'm going to loose my home :(

Hi
I have been in rent arrers for a while now and was tooken to court, on 18th june this year the court granted a postponed possesion order on the ground that i pay my rent plus £3 off the arreers.
I work part time and my wage fluctuates each week so each week i have to take my wage slip down the council and have my benefit re-assesed to stop any under or overpyments (was overpayed council tax benefits by £200 after they told me to bring wageslips every 5 weeks!)
Anyway, i have been paying every week except the last few weeks i got in a right muddle, i usually pay on a monday or thursday, but i had an accident 3 weeks ago so couldnt get into the council, i payed my rent based on the estimate on the councils website then took wage slips in the next week, i think this is where it's all gone a bit wrong.
basically the letter says
Your payments are not covering the shortfall in your housing benefit, you have therefore breached the order and in 14 days the trust intends to apply to the court for a fixed date of possesion, when this is received you will have to vacate the property on this date.

Please contact me (housing officer) within seven days of receipt of this letter to confirm your agreement of the rent arreers or if you dispute the figure quoted.

you have a right to apply to the court:
1. For a further postponment
2. To stay or suspend enforcement

You will need to contact the court directly when you receive correspondence fixing the date for you to vacate the property.

I'm not the most intelligent person on the planet and dont get the full jist of it.
By the wording of that letter does it seem that they are going to go to court definately even if i speak to her on monday to explain the situation?
I cant loose my house, i've got a little boy who starts school next year, this is going to really unsettle him, i know i shuld of payed my rent before but i'm really trying to sort it out now, i've been paying, now i'm in arreers with my council tax and having to pay £140 to them, i just dont know what to do anymore, i'm crying so hard because i've failed my little boy :(
I'm going to loose everything.............

  • I think what they are saying is that you have only been paying the arrears and not the additional £3? I would ring on Monday to clarify the situation and then get some legal advice via CAB or try shelter - link attached

Hope that helps? Is there anyone (family etc) who could help you financially? Are you able to get more work or more regular work as this seems to be part of the problem? Places like tesco are very flexible on hours but I appreciate its hard as a single parent with childcare costs etc. Can you post your SOA to show whats what?

  • hi there, and first of all, take a deep breath, and get yourself a cup of tea. from the wording in the lettter they seem to want to first of all check that you think their calculations of rent arrears are correct, my advice would be to go in on monday and talk to the council. have you got enough money to pay the arrears on monday? or at least a payment as a gesture?

  • Thanks guys,
every time i go into the council they print me out a sheet or tell me how much benfit i get for that week, then work out how much i have to pay, i pay that plus the £3
My work does give regular hours but i someontimes end up doing more, if i get sked to pick another call up when i'm out.
i want to get a new stable job but i've only been in this one 7 months and dont want to look like i cant stay in a job long :(
I rang shelter and she gave me options, also told me i can go homeless at the council.
    My house is housing association.
I dont have anyone to help me financially, at the mometn i'm off sick from work so only get ssp, my arrers are £1k so i cant offer much off that, tbh i can probably pay a bit more than the £3 a week and i think they'd accept this, i just dont want it to go back to court and loose my house.
i've tried so hard to get myself straight, and now it's all going bad again, i just dont know why i bother.............

    Hello melly
I agree with what's been written above - it sounds like they want to check you agree with them - and it sounds like you do - and importantly they're telling you you have the right to apply for a further postponement. It sounds really important that you keep on paying that £3 that's paying off the shortfall - it'd be awful to lose your home for £3 a week, really terrible. The rent and that £3 (and your council tax) are your priorities, really, as they keep the roof over your head.

I don't know much about this area of things, but I do know its hard. Keep calm, and keep your blood sugar even- it can sound odd, but it really helps to be able to think properly.

    All the best

  • Hi there Melly,

You need to stay calm for the sake of your little boy. The council don't want to be the ones that take your house away from you, the publicity would be awful.

You need to go and see them and ask them to explain what you should do. They are there to help you, and you are obviously trying to be reliable and pay what you should do.

Its Sunday today, so there is nothing you can do right at this moment. So take care of yourself and your little one today, and get yourself ready for tomorrow when you can go down and talk to the council.

They have much worse debtors than yourself, you are one of the ones that are paying!

Do your best to enjoy this day, and not to worry. You can't fix things until tomorrow, and you will do that then.

    Big hugs!

  • Hi Melly,

    First off, don't panic!!!

In retrospect you should have contacted your Housing Officer when you had a problem making the payment 3 weeks ago and also to make sure you are paying enough each week. I know it's a pain to do but in cases where your wage fluctuates it is essential.

If you are only paying what the court order says plus what the HB website says are you taking into account that you *may* have an overpayment which is being deducted from your ongoing housing benefit resulting in your rent not being met - that is what I suspect has happened from the wording of the first paragraph (shortfall of housing benefit).

Reading the letter, yes it does sound like you will be referred to court even if you speak to your association. However, that in itself isn't a reason not to ring them! At this stage, yes there is a possibility that you will lose the property but it isn't a foregone conclusion. Without knowing what the exact court order itself says (ie the type of order given - posession postponed with date to be fixed, possession in x days suspended, adjourned etc) its hard to say what is going to happen next.

Looking at the letter I would guess it is postponed with a date to be fixed, which basically means that when you were taken to court in June the association weren't given a date to take possession of the property and as long as you maintained payments then they couldn't take possession. For them if payments haven't been made as they should have been this is the next step - applying for a fixed date for possession. When this is received if you don't move out they will then have to apply for an eviction warrant. This all takes time.

I think it is up to the judge whether to have a hearing for a date to be fixed - if he does then you obviously turn up at court on that date and put forward your case. I would also suggest if they do refer to court for a fixed date then see if you can ask at the court whether they will have a hearing to prevent the date from being fixed. If this can't be done and a fixed date is given you will have right of appeal when you receive your eviction date.

Obviously ideally you don't want it to get this far, but it's only fair to warn you what may happen. Ring them first thing tomorrow morning and speak to them and let them know what your situation is and ask if there is any way it can be stopped from referring to court. Depending on the level of arrears they may not refer it to court but from their side I would imagine they have been contacting you for some time about this as they have strict procedures to follow. If they can stop it and are willing to do so, look on it as lesson learned and keep in touch with them to make sure you are paying enough - honestly most people would prefer not to refer cases to court and would much rather talk to you regularly to stop this happening.

Don't offer more than £3 a week - if you can pay more than that pay it but the offer has to be affordable for you and if you are on benefits then £3 pw is all that the court would award.

Stop worrying about it today, there is nothing you can do. Call them tomorrow and PM if you need any help.

  • I would just like to add a little advice here. Please speak to your housing officer tomorrow and fully explain the situation. Carrying on paying the £3.00p/w they "May" refer it back to court but this is just procedure. From experience once the Judge sees that you are making your payments as agreed he will not move to give them possesion of your home. Your housing Association would be loathe to reposess your home as well as they are usually charity based and are more concerned with keeping you in your home and recieving the arrears. I am sure your housing officer will be sympathetic. If he/she is not then ask to be referered to there manager.
Most of all please try to stay calm today and relax, you cannot do anything until tomorrow morning and just as a bit of moral support have you a friend or relative that could accompany you tomorrow to see the housing and help yout o explain your predicament.

  • Thanks guys, they havent been trying to contact me, this is the first letter i've had from them about it, i realise i was stupid for not calling them when i got in the muddle i am definately going to call my housing officer tommorrow.
Mum popped by when i was in a state and i ended up breaking down and telling her the whole story, she had a go at me and said over her dead body would she let me and my son be homeless, she's offered to pay the arrears for me but i dont want to be in debt to her for £1k, i'm due some compo money but that could take at least a year i reckon.
I'm hoping they dont take it to court but because of the amount i think they will, so i'm goign to see if they would accept a few hundred to clear some and keep making the payments, i guess i can only ask.
Sorry about earlier i just got myself into such a state but feel alot better about it now as i know if worst comes to worst my mum will clear it for me then i will give the money back to her with my compo.
I know i shouldn't rely on her to bail me out but i am at risk of loosing my home so i think i might have to.
Thank you so much for all your replies xx
