Hi everyone,
Some of you may remember a post I started about 1 week ago regarding the fact that I was assaulted whilst at work. My employers are progressing my complaint and going along with the official greivance procedure which I am pleased about, however I personally doubt anything will be done at the end of it as there were no witnesses to the incident. I am now going to explain the bit that I am hoping to get some opinions on:-
This guy that manhandled me, HAS done this before at work. A while back he assaulted someone and THERE WERE witnesses that stated what happened. The company decided to take no action. More recently there was an incident where he was alleged to have threatened someone else. Everyone knows that it happened because they saw it, but when company asked 'victim' about it, he denied it ever took place - I think because he was a bit worried he was gonna get a beating if he spoke of it.
DO YOU THINK IT RIGHT TO HOLD EMPLOYER PARTLY RESPONSIBLE FOR THE FACT I HAVE NOW BEEN ASSAULTED BY THIS GUY? CONSIDERING THEY CHOSE TO TAKE NO ACTION WHEN HE DID IT BEFORE AND THERE WERE WITNESSES.... IS IT RIGHT TO EXPECT THE COMPANY TO COMPENSATE ME IN SOME WAY FOR THIS INCIDENT...

Please do not shout!
Your employer has a duty of care towards you. If they had actual proof that this person has previously been violent, then they had a duty to act, and prevent this person from assaulting anyone else. However, as they took no further action on the previous occasion, I doubt that they found actual proof. Do you know the specific reason for them taking no further action?
If the act against you was proven to be reasonably foreseeable, then you would have an action against your employer. However, this could become quite acromonious. Do you still wish to work for the employer?Gone ... or have I?0 -
If someone assaulted me at work or otherwise I would make a complaint to the Police.
