H&T KwikLoan - Unauthorised Debit Card Use

I have cashed a number of cheques with H&T over the last couple of years, all of which have been payed when presented.

The last ones I did (3 x £ 100), rightly or wrongly, were returned by my bank.

H&T have put 3 transactions ( 1 x £10, 1 x £105 & 1 x £ 250) on my girlfriends debit card. They say that because this card was used to make a payment a couple of months ago (by her on an account that I owed) they are allowed to take these payments without any permission from anybody.

It is my understanding that companies are not allowed to store full details for the purpose of future transactions of this nature.

Am I right?

I think you are right in that they cannot do this.
She needs to contact her bank and query the transactions and ask for a chargeback.

You seriously need to pay them off PDQ!

I’m a bit stunned. To try to recover the money by carrying out card fraud is one thing. To carry it out in a way that makes it look like card fraud is something else. Starting off with a very small amount, to make sure the card details are still good, followed up with increasingly larger amounts, is exactly the sort of thing a card fraudster does.

I wonder if an increase in this sort of behaviour is an unfortunate consequence of the new rules for reporting fraud. Companies know they can now behave in such a brazen manner, safe in the knowledge that the police will never be made aware of it.

  • Sorry to drag up an old thread, (it came up in google)

    I'm in a same situation.

I defaulted on a Payday loan 3 months ago, I'm in discussion with a payment plan. (£60 a month) Starting next payday.

They have took a £1 and a £240 from my wages through my debit card. I havn't authorised this could I get a chargeback?
