Debt Collection

My DD's ex boyfriend became bankrupt last year ( discharged after 9 months ), he has just given me a letter from buchananclark + wells chasing an old debt on behalf of EDF energy , he has assured me this debt was included in the bankruptcy. He spoke to them about 2 weeks ago and sent off the bankruptcy details , they have responded by given a formal demand ,

Could someone please advise what we should do next?

    I'm certain that if this debt existed before the bankruptcy order, then they can no longer request payment as it should be marked 'satisfied' upon discharge. I would send them another letter reiterating the above. have you also sent them the certificate of discharge? Try not to let them annoy you too much - it sounds like they're trying it on.

    Hi lesley,

    They're trying it on, what Neko says is "spot on," from their point of view why not put pressure on somebody to pay a debt they're not liable for? Some of these companies have the morals of a wounded rat. It's also worth referring any correspondence to the O.R's office that handled the bankruptcy.

    Tbh I'm not 100% convinced he knows what debts were included ! , and i assume if it wasnt included he would be liable? Is there anyway we could prove that it was? , bearing in mind hes telling me he doesnt have any details of what was included ( is this normal? )

    Off to find a sharp pen to give myself a lobotomy .....!!!!!!!!!!!!!!!

    Thats why I said 'any debt pre-bankruptcy' and not 'any debts he remembered to include'. ANY debt pre bankruptcy, forgotten or not, will have been written off. Good news huh?

    Hi lesley,

    All debts with the exception of student loans and court fines, up to the date of bankruptcy are included, it's irrelevant whether or not they were declared at the time. If he asks the O.R for details of what debts were included they should be able to supply them. Any letters or demands for payment that won't accept your son in law's assurances then just forward them to the O.R.
