Dispensation result ....

Remember i posted a thread saying i had a court date re dispensation of having name put in the newspaper to protect my daughter ...
well went to court yesterday the OR was there and the judge was very sympathetic but said he could only grant a dispensation if I was in any threat from an ex ...so if i was in a hostel or a refuge and either myself or my children would be in danger of ex knowing then it could be done but only the address omitted the name still had to go in paper .... it was worth a try ...you know how nasty kids can be at secondary school when they hear things from their parents and don't understand the situation ...

Looking at the court listings on the website and realising how many people are going BR in our area alone I am suprised I've never seen it before either. I suppose I could scour the local paper to find the BR lisitings. I'm assuming it is a small official list somewhere rather than a full page advert naming and shaming? My worry is personal rather than for my kids... I don't want to give the little b*****ds at school one more thing to tease me about.

    Hey Alan,

I'm a finance officer; can you imagine the potential for ridicule there? On the few occasions it's been mentioned my response was "ah yes, true, but I forecasted exactly how much and when it would happen". I also tried to escape paying that months tea money by claiming that it was showing fraudulent preference to creditors but it didn't work.

I admit children are different though, I would have thought your only response there would be to totally ignore them. Like some of the people who occasionally appear on this forum, if they don't get a response they get bored and move on.

    Desperate mum,

Sorry you didn't get the dispensation. We gave our children a standard response to counter any possible intimidation and that seemed to work.

It never even crossed my mind that the DS`s would get any stick. As it happened, I went looking for our notice and never found it and it was posted in the regional daily round here which is the biggest selling paper in the region. NOT ONE person has mentioned it to me or OH apart from our close friends who were aware of the route we were taking.

With the numbers of people going BR, checking out the classifieds to find out who has done it this week isn`t such a big thing as it used to be.

We've looked out every day since OH went BR on the 20th and have not even seen the notice, as yet.

It's a small, framed notice, unless someone was specifically looking for it, I really do doubt they'd even find out.

Hi DM - sorry that you did not get the dispensation, and I can understand your worries.
Like many others have already said, though, even if your name is published in the local papers, it is extremely doubtful that the neighbours will be trawling the papers looking for the names of bankrupts. The OR does have the right to publish your name in the London Gazette, and a local paper, but the people who scour the London Gazette are, usually, people like major banks/financial organizations, looking for possible fraud, and Insolvency Practitioners, who are looking for a way to 'make a fast buck' by offering you an IVA as a means to 'reverse your bankruptcy'.
Even in the local paper, your bankruptcy is hardly likely to be 'Front Page News' - it will probably merit a couple of lines, buried deep within the personal announcements. Your daughter's schoolfriends are most unlikely to read that part of any newspaper, and their parents, should they notice it, are unlikely to associate your name with that of your daughter, especially as children hardly ever refer to their friends by their surname. Even if there were any association, news like that is soon forgotten.
I was made bankrupt last October and I have never seen my name in the local press - nor have I met anyone who has.
I TOTALLY understand your concern, though, but try not to worry.
I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Desperate mum, I was worried too at first ,and wouldn't get out of the car when I picked the kids up from school (how sad is that)...but in the end I decided if anyone did say anything, I would tell them it was frankly non of their business, but if they were looking to follow in my footsteps I could put them in touch with all the right people.
