Can LLoyds TSB chase for defaulted Current Acc after 6 years???

Options
Out of the blue this weekend my boyfriend recieved a very bizarre letter from a company called Tower Investigations asking him to contact them. Obviously our minds went into overdrive, me thinking he had a secret child or something and after a weekend of worry he called them this morning and it turns out that they are acting on behalf of Lloyds TSB and trying to obtain £2700 for a current account that he held in 1997 and has not used since about 1999/200

Now this account does not show as been defaulted on his credit files (equifax and experian) and i cannot find on the other posts if the normal rules apply that companies cannot chase you after 6 years.

Please can you tell me if current accounts are treated in the same way as credit cards/loans etc?

Any help would be much appreciated as Tower Investigations and Lloyds are getting very snotty with my bf.
Thanks

if there has been no contact for over six years then the statute of limitation means they can't enforce the debt. you can of course pay the debt if you wish.

see for more details (if you page down there is a letter you can use to write to them if you wish.

  • I suppose the question is - how come he left the account with 2700 outstanding? Did he default and just leave the account lying there or did he think it was closed? I would be interested to know why they've suddenly got round to chasing this debt. Lloyds aren't exactly backwards about coming forwards when it comes to getting their money back!

I would be just a bit worried when you say he has not used since 1999/2000. Check, if possible, last actual date - it may be that Tower Investigations have contacted him just inside the 6 year period (even one day will make the account collectable).

i thought the 6 year rule meant 2 way communication. e.g if he doesnt reply until after the 6 years is up then they cant do anything?

Exactly - OP says "after a weekend of worry he phoned them this morning"
Letter = one way - phone call makes it 2 way communication.

    Not so.

The 'communication' from him has to be in writing or he has to make a payment. Simply calling does not admit the debt and cannot start the clock again even if the call is recorded.
