Bank Charges claiming if on DMP

I think I read somewhere the other day that if you're on a DMP that you can't claim your bank charges back.

The account had already been defaulted and closed before entering the DMP. Just wondering :confused: because I've received 13 envelopes with statements in today

  • I think the answer is both yes and no!

    Technically you could probably claim the charges back BUT , and it is a very big but, your creditors will get seriously p***ed off and will fight back.
    If you are on a DMP they may decide to no longer honour the arrangement and could pass you back to the collections departments and all the calls and letters will start up again!

    Yes, you could tell them to communicate with you in writing only but they will still hassle you a lot more than if you hadn't started rocking the boat.

    It's not really fair but I'm afraid that's the way they work so if you want to reclaim the charges prepare yourself for some more unpleasantness.

    Personally even though I could claim a fair amount back I prefer not to as all my creditors seem to have quietened down and are playing ball with the DMP arranged through the CCCS.

    I guess it depends on how much aggro you want!

    Why not do the Subject Access Request first, find out how much they owe you and if it is a sizeable amount use it towards paying off your debt. You might even be able to "call it quits" and suggest they use it as a F&FS.

    As reformed man says it's not worth p***ing them off, a couple of our clients have tried and ended up with legal action being taken forward even though that creditor has been happy with the DMP for some time.

    Best not to rock the boat. just claim on the account your still losing. however bear in mind a lot of the banks are closing the accounts in retaliation and you might not be able to get a new one so easily if your credit rating isn't great :)
