fraudulent pyments online please help

earlier this month i was trying to sell my car and i was contacted by a prospective buyer and asked if i would accept online payment i was unsure of this so contacted my bank and was told as we both used the same company HSBC that it was a fairly straight forward easy transaction and instant , once a sale was comfirmed the process of payment was made via the net i checked my online account and the funds were showing so felt safe to let my vehicle go,(oh dear you may say)the next day when i tried to transfer some money ,my account was locked and was told by my bank that it was a 3rd party fraud and the funds had been returned i am now £4000 out of pocket and the bank are saying they are not liable for my loss and it is a civil matter.please help if you have any info as to whether i stand any chance of getting my money back from hsbc.many thanks chris:(:(

    It isn't HSBC who have the money, it has been returned to its rightful owner: the person from whom it was taken fraudulently. Rather than chasing the cash you should be chasing the person who has basically stolen your car - I would suggest you report the matter to the police.

  • of course i reported it stolen straight away probably out the country the same night,but hsbc make it possible for these people to commit this type of crime by allowing them to breach security and peoples accounts so how are they in no way responsible ??? what they hsbc should tell people is internet payments work in the same way a cheque would so dont release any goods until full clearance has been approved not as i was informed by them that it is safe and instant .surely they have insurances for this type of crime ??????????:mad::(

    The Financial Ombudsman Service publishes some guidance on cheque clearing problems. I know that you're not talking about a cheque, but it might treat BACS issues in the same way (though I'm not certain of that).

    In your first post, you say that your bank told you that it was a "fairly straight forward easy transaction and instant"; in your later post you say that you were told it was "safe and instant" - there's a subtle (but I think important) distinction between those two statements.

    Unless you asked them, I don't think that HSBC are responsible for you not knowing how BACS payments worked. (I'm not meaning to criticise you for that - many people don't know how BACS works - but the fact you didn't know doesn't make HSBC responsible for telling you). If you did ask HSBC and they told you something misleading, that's a different story.

    I don't think it's fair to say that HSBC "makes it possible" the fraud to take place - by that reasoning, you "made it possible" for the fraudster to steal your car. I also don't think it's fair to expect HSBC to have insurance for this sort of thing. Insurance costs money, and ultimately the cost of that insurance would be borne by its customers - you.

    I have no idea if your insurance would cover what is essentially the theft of your car - have you checked with your insurer?

    they did in fact say it was an easy and instant transaction. how can i as a customer do any other checks than look online at my account you see funds in your account and presume they are yours ??? if online payments go for further checks then shouldnt they either not show or show as uncleared funds??? as a customer am i not already paying for the banks insurance in one way or another as they impose charges on us which gives them the profit to pay for INSURANCE AGAINST CRIME ?? their security breach or breakdown becomes my loss ?? next time the bank gets held up and they contact you to say the robber stole your money that would be ok??? or have you got insurance for that??? is it fair surely not
