IPA confusion

Both me & my hubby went bankrupt in Aug 2008 and the IPa was in place a few months later in my hubbys name only.
We both got early discharge in Jan/Feb 2009 but still paying the IPA.
Both of us were working at the time.
We then moved a while later and our outgoings rose, told MoonBeever who then told us that they had contacted the OR who has reassessed and:
"We can confirm that no further payments and your file will be closed in due course."
Then a few months later I recieved a letter from the OR giving notice of his release as my trustee, my hubby NEVER received a letter saying this, just me.
Then a few months after that I rang MoonBeever to tell them I had stopped working although my hubby was still working, they told me that I needed to ring the OR because MoonBeever had closed the file and we didnt need to tell them about any change of circumstances anymore, we should tell the OR and then if neccessary they can re-open the case if the OR decides its neccessary in the 36 month period.
I then rang the OR who said I need to keep telling them of changes until the end of the original IPA date about HUBBY.
They also said I DONT need to tell them anything about MYSELF because my letter of release means I am completely finished with now and the IPA is in hubbys name not mine.
I sent a letter confirming I had ended my employment and that my Child Tax Credit had risen due to this to the OR a few days later, we never heard anything back from this as the IPA was already stopped and the CTC increase wasnt as much as I was earning anyway.
Since then I have started working again, CTC has gone down again, hubby has had a wage reduction BUT we have just been granted housing benefit. None of which we have told the OR about yet.
Now we are totally confused about what we should be telling the OR as the housing benefit is in my name NOT hubbys, and we were told that my income doesnt need to be declared to the OR because the IPA is in his name not mine.
But we know that the SOA for the IPA takes into account the income/contributions of partners, so we really dont know what to do!
Please help we are trying to do the right thing but are completely confused as to what we need to do!
Thanks for reading!

Hi molly, The IS treat bankruptcies as totally seperate, this means that you no longer have a responsibility to tell keep them informed.
Your husband does still have to tell them of any changes that affect his position. Obviously if you live with someone else then their job affects him. He does not have to give them details of your job change but he does need to state that he is receiving a bigger contribution to the household expenses.
does that help?Hi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.0 -
Thank you debtinfo for your speedy help and advice

I rang the OR the other day and told them of my hubbys change in circumstances and they have told me the same thing again, that they don't ned to know my details.
They have told me that even though we are receiving housing benefit now.. or will be shortly, that the increase in income probably wont make that much difference as we were/still are below the excess surplus anyway to make any changes, so looks like everything will be fine
We checked about the IPA and wether it was suspended/cancelled and it is suspended as they dont cancel them anymore, and the paperwork says the IPA finishes 36 months after it starts and not when he's discharged, so it looks like we are stuck reporting back to the OR for some time yet, but its a small price to pay for the 'freedom' of the debts
We will propbably keep the OR informed anyway of my income/outgoiings just to be on the safeside though!!
Thank you again for your help, as always this board is a life saver!!0
