HElP HELP

My daughters old nursery are chasing money off me, she left the nursery 2 years ago and they have within the last month sent me a letter from a debt collecting agency stating i owe over £2500.00 and I have a CCJ against my name???

They have never tried to contact me before this debt and are bombarding me with threatening letters and calling my neighbours to check my address.

What can I do

    Hi pinkspots

Are you at the same address as you were at 2years ago? was this the address the nursery would have on file for you.

You need to look into the CCJ (get a copy of your credit file). If you were never sent court papers you may be able to get the judgement set aside.

As to whether you owe this debt, its probably best to start by asking for proof you owe it - http://forums.moneysavingexpert.com/showpost.html?p=11570893&postcount=2

Do you think there may have been an outstanding balance when she left?

We have heard of debt collectors calling neighbours before, it is not something they should do, they should only be getting in touch with you.

First, do you have any idea why they are chasing you for money, since it was your daughter not yourself that was using it?

You can have the CCJ setaside if they never made contact with you - http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=12_how_to_set_aside_a_judgment_in_the_county_court

There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies

DC - I think she means her daughter was at the nursery so is probably about 5years old now (well thats how I read it!) LOL

I thought that as well. Seems a bit too much tough love to let the 5 year old shoulder the responsibilty for the debt. :rotfl:

Anyhow, how did the debt arise ? I thought that the state paid for 5 sessions a week at nursery once the child was 3 years old. Is that not the case ?

    Do you owe the money?
£2500 is a lot i`m suprised they havent contacted you sooner!! If we were to miss a month they stop the nursery altogether unless you explain prior to not paying.

I pay my nursery fees via standing order, is this how you paid? if so your bank can get your account statements back even though it was 2 yrs+.

Did you leave the nursery without giving full notice? They can charge for this (if it's in a contract that you signed). Why not just give them a call and talk about it? Worrying about phone calls and worrying they're contacting your neighbours cannot be nice for you... and very stressful for your daughter too. Just sit down, take a deep breath make the call and see what can be done. Everything can be sorted out.
