Hi All
Am absolutely furious, to cut a long story short have been on my DMP since august 2006 with CCCS and all is going well. and i have now paid nearly 60% of my original debt...yesterday i got a letter from HBOS advising me that they are defaulting me 3 1/2 years after my DMP started :mad: (notwithstanding the fact that thanks to their insistence of adding interest AND CHARGES for first 2 1/2 years that i still owe £11 k despite payments of £8500 against an original balance of £14k.. they just wouldn't respond to me or CCCS :mad::mad::mad:)
Its so disheartening - most other creditors defaulted me in 2007 so that means by 2013 i will have a nice clean credit record and a small hope if getting a mortgage,,, now sodding HBOS have put that plan firmly on the back burner for another 3 years,,, is there anyway i can appeal ??? has any one else experienced this
thanks LLL
PS any newbe DFWs don't be disheartened by this despite HBOS being idiots a DMP was the best thing i ever did:A

Not as bad as you may think LLL.
The date of the default that will go on your file must be within 6 months of the date of the actual default (when the terms of the original agreement were broken). If they put on any other date, this will be a breach of the Data Protection Act as the data they are processing and sending to other parties about you is incorrect.
You can't appeal it, but you shouldn't be any worse off. It just gives them more options like going to court if they decide to do so later. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

Hi George UK
Many thanks for your reply.. so just to clarify they have said default as of Jan 2010 ..i orginally broke the terms in August 2006 so does that mean i should write back to them to query the date of default - sorry for being thick!0 -
If it appears on your credit file as Jan 2010, then definately get them to change it.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
