Finally went to community legal advice....

First of all hello, my first post in DFW's and hopefully will be here until I'm debt free!

I finally went to see CLA about my debts, I have been meaning to for quite a while but I lost my temp job on Xmas eve and have decided enough is enough. I start most days being called up by debt collectors and I'm sick of it!

They were very helpful, but I'm a bit unsure about a few things. Basically I was given a few options, either send out a financial statement to everyone I owe to and offer realistic minimum payments, or declare bankruptcy. This seemed a bit drastic but the guy I spoke to almost seemed to "sell" it to me....

He said since my debt isn't massive (about £5000) that it wouldn't have any drastic effects and that I wouldn't be "bankrupt" for very long?? It seems a little odd so just looking for a few opinions. To be honest I'm sure I can get by without declaring bankrupt....

My priority debt is £2200 which comprises of rent/council tax/water arrears and a CCJ. Other debts (credit cards, store cards) is £2700. I was also told to ignore credit cards etc and let them default, is that normal?

My income will soon be £684 per month (income support, child tax credit, child benefit and wages from sunday job). I'll be eligable for housing and council tax benefit so that will stop the arrears from getting any higher at least, however I'd like to pay off priority debt asap really as I don't want any rent arrears when I start another job. Outgoings will be £300 per month before paying off any debts.

Any advice, comments or suggestions would be very much appreciated

  • Give one of the free charities a call (CCCS or Payplan). In fact I think you can enter your details (incomings/outgoings) onto the CCCS debt remedy and it will point you in the direction of what you need to do.

    ditto what knitty78 says. Your best bet is definitely CCCs or payplan. If you go on to the CCCS website you can start filling in all your income/otgoings and creditors. You don't have to give any personal details: name etc, you just type it all in and then it will help you with a solution and give you a webnumber. You can then speak to them on the phone to go further forward with things if you wish to do so. They are fantastic people and will i'm sure be able to help.

    Obviously, Bankruptcy is the right course of action for some, but I think this advice to you was given too glibly. The ramifications of going bankrupt are massive and the fact that the amount of money involved is small will be dwarfed by the mere fact of going bankrupt. Also the advice to default on credit cards does not quite ring true.

    I would suggest you take further advice - eg the free charities. Or you could post your Statement of Affairs here [someone will post the link soon or you could search - there is another site which gets used] and everyone will pile in with ideas, after which you will have a lot of options to follow up.
