Deduction of wages???

Hi. This is my first post. I’ll keep it as simple as possible, so not to complicate/confuse.

I am employed full-time with a basic salary and, until recently, an added monthly bonus. As simply as possible, the bonus is based on: work done one month is paid out after 60days providing a) all necessary work is completed in this period , and b) target is met.

In Sept, I had a letter from my employer advising that with immediate effect the bonus structure would be withdrawn until further notice and any work that had already been done prior to this would be paid. This I understand.

The sticking point? Work was carried out in July (due to be paid in Sept once 60 days were up) and August (due to be paid in Oct once 60 days were up). Remember – I was only told that it was being withdrawn in and from Sept.
July’s work was paid in Sept, but August’s work still hasn’t been paid. Does anyone know where I stand with this?

I have discussed this with said employer who doesn’t feel that it should be paid. We're now at loggerheads. This structure was changed from an old structure this year. Does anyone know if a structure in place supersedes anything prior? (I have the structure in writing).

Any advice would be really appreciated. Thanks.

    I don't think you have a leg to stand on really, your employer sets the terms, they could have said no bonus for even work that had been done, they have obviously hit hard times.

    If they say no then you don't have much choice but ot accept it if you have already made a complaint which hasn't been accepted. What do other staff say?

    I assume the bonus payments are not in your contract and were only added recently?

    If thats the case they can remove the whole thing with no come back.

    You could do a grievance I suppose, it depends on how much of the boat you want to rock.

  • Vader - oh yes, it's definitely part of my contract. This was all signed on the dotted line back in April by both parties.
  • I think they are firstly out of order for unilaterally withdrawing an agreed bonus. The are further out of order for retrospectively withdrawing bonus earned

  • Just reduce your productivity to match the amount you now get paid.

  • Raise a grievance stating that you were informed on xx that the bonus was being withdrawn/suspended but that you had earned the bonus in line with the your contract for August.

    If you want you could also state that you did not agree to the withdrawing of the bonus scheme and, as it is part of your contract, you expect this to be honoured. This is, of course, accepting that there was nothing in your contract that would allow them to withdraw the bonus scheme without notice or consultation. They should at least have discussed it with you and given you notice of the withdrawal of the scheme.

    Reducing your output will only get you into trouble and see you going down a performance route which can result in your dismissal.
