summoned to a meeting at work 330 pm today

After liasing with citizens advice and acas,and when i last handed my sick note in. the supervisor said "got a job you could do,if it was up to me i would let you do it but manager wont like it as you`ll be picking and choosing your job".I wrote a letter stating all your advice and to complain about that with this other job to the managing director even quoting what the manager said.The managing director wrote back saying he`d passed it onto manager to deal with.(some grievance procedure that is!) Received a letter today dated 13th November asking me to attend a meeting tomorrow.I thought you was meant to get a weeks notice for things like that or is that just disciplinary.Concerned and nervous about it and regrettin finishing union as i couldn`t afford it.been off since august at their request has the job i was put on aggravated an arm injury,although there was other jobs i could do.More info can be found on sick pay/employment rules thread.

    Your absence, or your grievance? If you are not sure of the purpose of the meeting, you need to ask your employer!

    It doesnt make much sense to me either..the way I am reading it, is you have been on long term sick and although you have been submitting notes your employer want to meet with you. This may be to discuss how long you intend to be off, or when you envisage returning to work.

    As I understand it the supervisor has mentioned a job that he/she wants you to do but the manager won't allow it because you are off sick.

    As for your union subs..rather than cancelling you could have explained the situation to them and told them that you were on longterm sick leave and couldnt afford your subs..they would have kept you on as a member.

    Contact your employer and ask them what the meeting is about - if it is a disciplinary then they should have sent you a copy of the disciplinary procedure. You can always ask to postpone the meeting.

    To me it sounds like the OP is off sick and can't do their job.

    The line manager has suggested they have an alternate job they can do but the manager of the line manager isnt happy to offer this as it means the OP are picking and choosing what they do.

    This to me sounds reasonable as if the OP is incapable of doing their full job they need to be replaced and it may be that having 2 people doing part jobs etc isnt a suitable solution to this business.
  • At the end of august my employer restructured and the job they put me on aggravated an upper arm problem i had.when i protested about this.They sent me home said if your not fit to do all the jobs(even though at the time people were doing roles i could perform, and on the day i got sent home i was on a job i could do, and today when i went in it was the same) we don't want you here and go on sick and get doctor to write to us to prove it.My doctor said get them to write to me which they never have.

    all the time i`ve been struggling financially ever since with car debt,rent and all the usual bills.Redundancies came up in September i put my name down then they got canceled,though talking to people and seeing the stock piling up they maybe back on in a month or so.

    Yesterdays meeting was just an opportunity for the manager to rant.The grievance letter seems to have poured petrol onto the fire.

    Ranted he`d not told me to go home,which he did.The day all this happened got pulled into the office with manager and line manager,as i`d had a disagreement with another supervisor who swore at me so i swore back which i shouldn`t have with hindsight.

    Yesterday they said they`d taken minutes at the above meeting ,(in the meeting i never recall anyone writing anything,and when i asked if it was official they said no,as i was in a union at the time and would have wanted them there,or at least some witness) and i had admitted swearing which i hadn`t.Also from these minutes, i said i`d broken my wrist in the past which wasn`t helping me do the job either.I never said that either.I said that during a redundancy meeting when i volunteered as the manager said people with health problems would get there`s accepted ahead of "normal" people.

    Also so in yesterdays meeting the manager said they had other instances of me being rude to supervisors with witnesses.(only ever been rude when they`ve been rude to me,trying to bully me into overtime when i was ill).I have no doubt these can`t be genuine witnesses.and think there tying to fabricate things against me.I replied to that bombshell that it was a witchhunt and asked for more information.the reply was (with a grin/near laughter as he knew he was angering me)no it isn`t a witchhunt and we`ll sort it out when you return.

    They kept saying no one has a set job and couldn`t guarantee i wouldn`t have to perform the job i siad had aggravated my arm.Then in the next breath saying get a doctor to write stating what you can and a can`t do and we`ll look at doing something,which is a contradiction of what they said before.Just making the right noises legally.

    My doctor wouldn`t write to them last time he told me to tell them to write to him.Which they just ignored when i informed them.

    Before people dive in defending this company like i`ve seen on other posts,here`s a taste of what its like.
    1 year ACAS visited to investigate company has we had largest employee turnover in our county if not country.Also to investigate yard manager (who is now the manager i had to see yesterday)whipping people and putting cigarettes out on people,i only wish they`d gone to police instead.
    Earlier this year bullied people into normal rate over time for a total of twenty hours,their reward the unveiling of a machine which as taken over there jobs and there chance of production bonus.
    gave a false and malicious reference to an ex employee who resigned.
    Supervisors stand glaring and giving dirty looks and square up to you in an aggressive manner.

    I could go on all day,need to get out but its not that easy.

    With regard to your Union - contact them say that you were unable to pay the subs as you couldnt afford it due to being on long term sick and that your rep hadnt advised you that you switch to suspended subs or reduced subs and that you had no choice but to quit..appeal to their better nature and see if they will take you back on especially as this is an ongoing problem at work and you have been represented before.

    It is correct when the GP says that the company have to write to him and that he cannot write directly to them himself.

    Ask the manager for a copy of all minutes of meetings that you have attended where your performance has been discussed - you are entitled to these anyway.

    Swearing at people hasnt helped - even when they are rude to you, you have to grit your teeth.

    Do you have a copy of your grievance procedure? If not ask them for it - as you have submitted the grievance they need to investigate and come up with an outcome and they have to do this within the time frame noted in the procedure.

    If you feel unable to continue then you could try the employment tribunal for constructive dismissal - depending on your length of service. Remember that there is a 3 month time limit from the date of the last incident in which you can submit a claim to the employment tribunal..no reason why you can't start the process now because you can always postpone it further down the line.

  • Okay - you need to start with a letter clarifying your position. This puts things down in writing and formal, but you need to clarify some things in order to get meaningful help.

    You state that you did send in a grievance and that this was in relation to being told to go home as no job available for you. You then state that you attended a meeting yesterday and were informed that they took notes at the meeting in August - which I assume is the one you were told to go home?

    In the meeting yesterday there seems to be a change of tack in that you are now being told you are being rude to staff - I assume that you were not shown any evidence to substantiate these allegations? Although you do accept that you have sworn in the past - do other staff swear too? Has anything been said to you/other staff regarding swearing in the workplace before?
    Finally have you taken notes of the meeting? Was it you and one manager or a number of other people?

    Give the responses to these and you may get more constructive assistance. For example I would ask for copies of the notes by return as if they are there it will only require photocopying. I would be advising that I was sent home. Would also inform the company that I am willing to see a company doctor and/or sign authorisation for the company to contact my gp to get information about my disability.
    However, how I would do it does depend on the information being accurate and as clear as possible from you.
