Hi everyone
CCa Very and today recieved a signed CCA back. However the account as opened in 2000 and the CCA they have sent me is dated 2004? bit of a miss about what to do next as I thought they needed to send the original not one from 4 years later. Any advice?

Hi Devon
They need to send whichever CCA is enforce at this time - did you re-sign a new agreement with them in 2004?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Thanks for the reply Tixy. No really sure such a long time ago. It does not have any interest details on just a bit about the agreement, The credit limit, the statement, special offers, bnpl, what you must pay, charges although no interest rates shown and how to pay. Has my signature on it and a date in 2004.
Cant scan it as have no scanner.0 -
Hi
i have had the same problem with Littlewoods, mine was dated 4 years after the account was opened, so in my mind this cannot be a copy of the original cca that should have been signed on the opening of the account
i reported them to the OFT
Here is part of the OFT'S reply to me
A copy must be a copy. It need not be exact on immaterial points, but cannot be a conjectured reconstruction.
If the trader has no original copy, the trader will have difficulty showing that he has complied with the regulation by supplying a ‘true copy’, since nobody would know what was in the original
hope this helps0 -
Thanks Misty Blue thats interesting.0

I have received a letter from Cabot with a photocopy of the original cca and a current 'small print' booklet. The CCA has the name printed on it and it is spelt wrong.
What is it the I should be looking for on the CCA. Should I find the interest rate etc on it.
Thanks
GOne day some company will do what they say they will do and charge a fair charge.:T

Or maybe not:mad:0 -

Sorry to bump but can anyone give me some advise...the rate and repayment frquency is in the small print booklet but not on the form. The dates on the form have no year either as well as the surname being spelt incorrectly.
does the intrest rate have to appear on the actual form. The booklet they have sent is clearly a new one and not what was in force at the time...
Cheers for any adviceOne day some company will do what they say they will do and charge a fair charge.:T

I would make sure you keep anything they send you . IF it ever went to court , I very much doubt a solicitor would dire turn up with a document with the wrong spelling of a debtors name on it ! Also have they sold the account to the DCA , request a notice of assignment .0
