Hi All,
Once again I am looking for wisdom, so lets start the story, first off all lets rewind my life 4 years ago, I lived in Leeds and worked for British Gas, after my relationship broke down, I resigned from work, handed in my notice and left, I recived my final pay slip and P45 and moved home back to the North East.
Now fast forward 4 years to oday when a letter drops though my door, from Centrica (Owners of British Gas) saying Notice of Intention to Issue Court Proceedings
It Says
Re: Proposed Claimant - Centrica Plc
your account has been passed to us to commence legal proceedings against you in connection with a debt that you owe to Centrica plc. The debt relates to a salary overpayment made to you.
TAKE NOTICE that according to our records the sum of £327.97 is overue for payment. Despire numerous attempts to recover the sum, the debt is still outstanding.
To avoid additional court sosts plus ongoing debt intrest you must make full payment of the outstanding amount within 14 days from the date of this letter. Failure of this will result in legal proceedings being issued to recover the debt without any further notice.
A country court judgment against you will affect you credit status.
To make payment by credit or debit card or duscuss thie matter futher please contast us on
We strongly suggest that you take independant legal advice.
Now It seems just like a scary pay us please letter, but I am rather annoyed, I have not worked for them for over 4 years and the letter states that despite several attepems i havnt paid, well this is the first letter I have ever recived from them, can they really issue a ccj againt me for a salary overpayment. I don't think I was ever over paid like I said i recived my pay slip and P45 surley if there was going to be an overpayment they should of just taken it out of my final slary at the time.

I would take advice from the CAB, but would probably start by disputing it and asking them for a full breakdown of when where and how the 'alleged' overpayment was made together with all supporting paperwork and details of all the supposed attempts to contact you over the last 4 years.
Do you still have the payslips etc etc to check and prove you do not owe this money?
I doubt this will go anywhere so wouldn't worry unduly.

As olias says. Do it in writing keep copies. Also, dispute "Despire numerous attempts to recover the sum, the debt is still outstanding." if this is the first you have heard of it.
One of the effects of the credit crunch appears to be companies dredging through old records to find any claim they think they can make against anyone based on the flimsiest shred of something unresolved. So, besides writing as above, you could ask for all salary records appertaining to your employment. If it were to go to court, they would have to provide these for you anyway if you asked - so you might as well ask them now, to increase their pain in following through with this.Hi, we’ve had to remove your signature. Thanks guys, Im going to write a nice letter over the weekend, I think that I may even point out to them that on there letter it says they are open mon - fri 9 - 5 but when u call at 4:30 it says they are closed lol, Thanks for the tips Ill see what happens and keep you updated0
