Unfair default on credit file - 3mobile.

I have an unfair default on my credit file, which I suspect is causing major problems (increased CC interest rates, and a declined application).
Story:
2008. My daughter ran up a massive bill (£700) so I called 3 to ask that I could pay over a period of time rather than all at once.
They agreed quite readily to what I thought was an amicable arrangement between me and 3. I cancelled the mobile contract at this time.
Moving on, I was called by a debt collection agency to arrange a payment schedule!
I wasn't best pleased and argued that I had not realised that the debt collection agency would be involved. No joy. I did as they asked and had no idea that it would have any effect on my credit rating. All payments were made on time and the account was cleared within 4-5 months.
I now have a default on my Equifax file and three late payments and an unsettled amount of £300+ on Experian.I have necer received any correspondence noting the default.
I have called 3mobile and recieved this response ...
I have conducted a full review of your 3 account and I can now confirm that the Credit file is amended to show the account balance has been paid and the default is now satisfied. The default status, default balance and the payment history will remain on the credit file as a true reflection of how the account was managed.
Once again, please accept my apologies on behalf of 3 for any inconvenience you feel this matter has caused you and be assured that 3 value your comments in helping to improve our services.

Did you get a default notice in the post from 3 (or from a DCA) - they have to send this before they can register a default. If you are certain you didn't then it should be removed.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0

Hi masquerade - not totally sure what your next step should be - I've tried to look into it a bit for you

So I think maybe the first step is either to write and say you never received a default notice and that you want the default totally removed from your credit file or you will make a formal complaint to the ICO or you could do a SAR to see if they hold record of a default notice being sent.
Sorry I can't give any more definate advice.

However they said that they would now put that down on some kind of data base to say i was late paying so i think i may have this bunch of cowboys now ruining my credit history aswell!! just because they are so bad that it was the only way to get some action!
I THINK THREE MOBILE PHONE COMPANY ARE A DISCRACE AND SHOULD BE SHUT DOWN !!!!!!!!!!!!!
did you actually find out if three should have managed this debt correctly as i thought that the phone should cut off at £500 as when i took out my contract i said that should i leave it on by mistake i wanted to set up a limit so as to not run up a huge bill and that is what i was told!
in any case this should have sent alarm bells ringing at three mobile and they should have made sure that some one should have given the contract holder a call as the phone bill was exessive to say the least?0 -
Yes, there was a credit limit of £500 but they choose to ignore this fact.
What a huge pain this is. Makes you realise the effect a default can have on your life - it's scary stuff!

I have been in touch with ofcom and then otelo they are the telephone regulators they will ask you if you have exhausted attempts to sort out the problem with your network provider however it sounds like you have done this,
you will find contacts for these on the Internet, if you explain they will give you a reference number to be able to call three mobile head office in Scotland.
If you are not satisfied then otelo will give you a form to fill out to take it further!
if you have done all that then I would say your last hope is a solicitor!
although you can get advice for half hour free of charge with most solicitors,
I was told that the record of late payment is no so bad and as the balance was fully paid!
Although it sounds to me like three mobile have neglected there duty of care unless it was common for your daughter to run up a £700 bill and a regular basis!0 -

My daughter is not normally so careless but she was abroad and needed to call home often. I knew it would be a big bill, but not that huge!0 -
I certainly agree with this they should be shut down, I had dealings with them when I lost my dad 3 years ago and had constantly told them and sent them a copy of the death certificate however, all communications lead to the insisting they speak to the account holder,as you can imagine horrified that they weren't listening to a word I was saying so in the end having totally lost it I told them they would need to make a long distant phone call as he was I repeat DEAD. eventually they got the message but it took a year.0

Right! Taking action:
I've called OTELO who gave me a reference number to quote and the name and address of the appropriate complaints person at 3 mobile.
They advised on the structure of the letter and will give 3 mobile 8 weeks to resolve. Failing that, they will take over the complaint.
I've written the letter to 3 and will post tomorrow.
That feels better!
