merton bailiffs

Hi

I was visited by a bailiff yesterday but wasn't at home and they put a Notice of seizure of goods and inventory from Merton Bailiff services through my door. (inhouse bailiffs)

Their charges seem extorionate and are as follows

Local Taxation Outstanding £399.10
First letter fee £0.00
second letter fee £0.00
statutory levy fee £37.00
walking possesion fee £0.00
Enforcement costs £200.00

total 626.10

the inventory relates to my car

I am fully aware that this debt is my own fault but object to the £200.00 enforcement fee and am wondering what it is for and why it's so much as a neighbour was only charged £100.00 for the same thing in December last year although the C/Tax owing was about £280.00.

My only income is benefits and I cannot afford to pay this in one go and they wont accept a payment plan and the council wont take it back.

can you advise me please, they want it paid by monday and if I don't they will take my car and I need it due to disabillity.

advice urgently needed???

  • you mention that your income currently is benefits, i take it this debt relates to a time when you were working fully?

    thanks bank-of-slate

I have looked at the site and many others but still cannot find any definative answers as to what the Enforcements fees are ( apparently they are not leagal)

Have tried to email Herbie21 but her inbox is full and I cannot afford the cost of calls to her helpline nor the £10 fee for online advice as I am totally skint till tuesday and even then am on such a restrictive budget that I still couldn't afford it!!

I cannot even call the council or the bailiffs or go to the town hall as I have NO money

No it's this years Council tax the benefits I'm on are
Child benefit, Child Tax Credit and Widowed parents benefit, so I'm just above the threshold for 100% H/b and CTax/b so have to pay quite a bit each month but there never seems enough , I know i should priorotize my money better but never quite manage it

to top it all I have today received 6 letters from a company calleed Rundle and co 3 dated 6/8/09 headed REMOVAL OF YOUR GOODS and 3 dated 10/8/09 headed FINAL WARNING Parking Fine due to London borough of Tower Hamlets.

I don't know any details of dates/amounts as there wasn't anything on the letters

I haven't had anything from either Tower Hamlets or Rundles before today ( I know someones going to say I have BUT I REALLY HAVEN'T)

I'm now scared whitless as what am I gonna do if they turn up for money (either of them), Can they both levy on my car?

Try not to panic. Contact both companies in writing asking for a full breakdown of the accounts and any charges added - I think there are template letters on here somewhere. When you have all the information you can see what is what. In the meantime try calling CCCS on 0800 138 1111 (free!) and see if they can help.

  • regardless of the amount tho, surely the fact that your income is entire state benefits, shouldn't you qualify? when people are on jsa for example (with tax credits and cb for kids), they still qualify for HB and CTB.

Thanks Herbie21 for your reply, I assume you are tomtubby on cag as the reply on there is exactly the same as on here.

I have looked at your website but cannot find any definative advice as too charges allowable in respect of what can be done legally to get rid of the "enforcement costs"

I cannot afford to either call your helpline or sign up for your online help but thanks anyway

This morning I checked the online council tax account balance checker and it says that the outstanding balance is £636.10

can they do that? I mean my council tax isn't £636.10 it's £399.10 so I don't understand how I can owe the COUNCIL that unless they have told the bailiffs what to charge.

I know they are inhouse Bailiffs but surely thats not allowed!

well Just got home from an arduous few hours at the hopsital with my mum and theres no reply to either of the emails I sent on Friday

having said that I doesn't look like the Bailiffs have been either as there weren't any more letters hand delivered with more charges on them so thats good I suppose
