Cancelling LA Fitness membership

Hi,

I moving house very soon and as a result I’ve had to cancel my Gym Membership with LA Fitness. However, they require a months notice. I cancelled the membership on the 26th March and cancelled my direct debit straight away as well. (directdebit is on the 1st every month).

I received a letter in the post on the 3rd April (after they tried to take money out of my account via direct debit, but failed) that I had to pay the 1 months fee as I had not given them 1 months notice period. I think it is ridiculous that I have to pay for something I don’t use. I can agree with notice periods on tenancy agreements etc, as they need to find someone to fill my space, but gym memberships?!?

I have a financial contract with them which was for 12 months. On the back of this agreement it states that once the 12 month period is up, the membership will continue until cancelled in writing by either party. I have to give 1 months notice if I wish to cancel. We have been members for almost 2 years and are out of the contractual 12 months agreement.

HOWEVER, when reading what I signed, I read it differently. It is as follows:

I/We declare that we are fit and able with no major injuries…etc etc…

I/We sign to agree that we are bound to the data protection act as described overleaf.

I am arguing here that we signed up for 12 months and are legally bound for those 12 months. I did NOT sign to agree to the terms and conditions as they did not tell me to sign for those. Sure, they got a box out informing me to read them, but there is no where for me to sign that I agree with them.

Not sure where I stand on this one. I’ve so far sent them 2 complaint letters saying that I DO wish to join up with the SAME gym when I settle in my new home, but they are not budging. This has now become a matter of principle for me. I will fight this one to death (whether I will join the gym if I win is another matter).

Any advice or comments to my case? Am I required to pay this 1 months notice? When I get home I will add a link to an image of the contract so you can read it yourself…

    Chances are your gym will pass your debt onto a debt collection agency.

    Gym contracts are hard to get out off.

    Cancelling your direct debit was your 1st mistake, once your direct debit fails this alerts the gym to non-payment then it puts the wheel in motion there end to chase you for the money.

    The T&C's will form part of the contract you signed up to. If the contract says one months notice, then you are required to give one month's notice.

  • Spoke to them today and they are real !!!!!!!s...

    I will have to pay as I don't want a bad credit mark.

    However, they are ignorant moneysucking beings that have no desiree to please customers.

    They now gain one months membership, but loose several years as I will not be renewing it when I move to my new place.

    I've been a member for 2 years, bought a few addons as well, but now they are just interested in the 1 month. What happened to customer retention?

    I guess I need to go "name and shame them" :)
  • Sorry to bring up an old post, but I've been away for some time and came home to a letter saying that I was in arrears of £0.00 so they have charged me late payment charge of £40 and will pass on the debt to a debt collecting agency!

    How can they charge me late payment charge on arrears of NOTHING!!!

    These people aren't a gym they're bloodsucking monsters who are not interested in your health....just your money.

    I've now joined a new council run gym which is actually pretty good and reasoanbly cheap as well....should have done that the first time around.

    Hey FTB, I gotta say, although it sucks royally, modern day gyms - or 'Health Clubs' - are money sucking leeches. I know this for fact, as I used to be a 'Membership Consultant' for one of them (thank goodness I've moved on...). It's all about agressive sales tactics. Unfortunately all most of the sales people at gyms see is £££. Then it's all push, push, push to get the sale, often with the finer details perhaps not explained as fully as they should be, leading poor customers to be left in a state of bother, such as yourself, upon choosing to cancel membership. Again, it sucks majorly, but contracts are contracts. Good to hear that you've gone the council-run gym option now. In my opinion, that's certainly the best option these days aside from a cheap set of weights from the Argos catalogue sitting in the corner of your bedroom.
