ELIGIBILITY: This draw is open to any person resident in the United Kingdom and Ireland who is 15 years of age or older at the time of entry excluding employees and their immediate families of Microsoft Limited (“Microsoft”), the promoter (the “Promoter”), their agents and anyone else professionally connected with the promotion. Entrants who are under eighteen must seek their parent or guardian’s permission before entering this promotion. Microsoft reserves the right to verify the eligibility of entrants and check their identity.

1. TO ENTER: Either Visit http://www.messengerbirthday.com and click on the “Play Now” button to launch and Messenger Mayhem game with one of your Messenger Friends, or visit Messenger and select Messener Mayhem from the Games section. (If you are not already signed in to Messenger you will need to do so before you begin to play). You and your Messenger Friend will play Messenger Mayhem and if you reach a target score (as described in Section 4 below) together you will be entered into the prize draw for that ten (10) minute interval. Once you have entered with one Messenger dFrien, you may not enter again with that same Messenger Friend during the same twenty four (24) hour period, although you may enter again with a different Messenger Friend during the same twenty four (24) hour period. Microsoft is not responsible for lost, corrupted or delayed entries. No purchase necessary. Entry constitutes full and unconditional acceptance of these Terms and Conditions. Microsoft reserve the right to disqualify anyone in breach of these Terms and Conditions.

2. TIMING: This promotion runs from 10.00:00 am GMT on 22nd July 2009 until 09.59:59 p.m. on 31st July 2009 (inclusive).

3. SELECTION OF WINNERS: Winners will be determined at random once they have entered by reaching or surpassing the target score of 18 in the Messenger Mayhem game. Winners will be notified instantly after completing their game if they were the winner for that ten minute interval. The winners may be required to participate in further publicity or advertising. Users are only permitted to win a prize once per day if they play with the same Messenger contact.

4. PRIZE: There will be 2 (two) £10 Play.com vouchers available to win every 10 minutes between 10am and 10pm during the promotional period. The Prize is given out to both players of the game, each player receiving one (1) £10 Play.com voucher. Prize codes will be displayed instantly to each of the player and additionally winners can choose to have their prize code emailed to their Windows Live ID at the time of winning. If the code is forgotten or mislaid no replacement will be issued. Prizes are as stated and are not transferable. No cash alternatives available. Microsoft reserve the right to substitute prizes of equal or greater value. In the unlikely event that a Prize cannot be awarded during a ten (10) minute interval for any reason, Microsoft reserves the right to select a winner at random during that day to insure that 72 Prizes are awarded (equal to 144 individual £10 Play.com vouchers) each day of the promotion.

5. OTHER: No correspondence will be entered into regarding either this promotion or these Terms and Conditions. In the unlikely event of a dispute, Microsoft’s decision shall be final. Microsoft reserve the right to amend, modify, cancel or withdraw this promotion at any time without notice.

6. Microsoft cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Participants in this promotion agree that Microsoft will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in this promotion. Nothing in this clause shall limit Microsoft’s liability in respect of death or personal injury arising out of its own negligence or arising out of fraud.
