"Up to £10,000 in Gold Prizes to be won."
(Searched Gold Rush/Juarez)
T&C:
2. The Prize Draw is open only to individuals who are aged 16 and above and who are residents of the United Kingdom or Eire, although the following shall not be eligible: employees of the Promoter (as set out in paragraph 23), their immediate families and anyone professionally connected in any way with the Prize Draw. The Promoter reserves the right, but shall not be so obliged, to verify eligibility qualifications of winners.
3. Minors (i.e. persons aged 16 or 17) must have authorisation from their parents (or the person who exercises parental authority) to enter the Prize Draw on the terms of these Rules.
4. Access to the internet is required. Entry to the Prize Draw is free and is made through the webpage located at https://www.juarezgold.com, callofjuarez.com/goldrush, callofjuarez.com/orange and callofjuarez.uk.ubi.com/goldrush (each being referred to in these Rules as “Site”).
5. No purchase is necessary to enter the Prize Draw or to win a prize.
6. Entries must be made after 18:00:01 on 18 June 2009 (GMT) (the “Start Date”) but before 23:59:59 (GMT) on 3 August 2009 (the “Closing Date”). Notwithstanding the fact that the Site may appear to be active after the Closing Date and appear to accept entries, any entries made after the Closing Date will not be eligible for the Prize Draw. The Promoter reserves the right to alter the Closing Date if, in the Promoter’s sole opinion, circumstances outside the Promoter’s control dictate that it be fair to alter the Closing Date (although the Closing Date will not be shortened). If an extension is made, a statement to this effect will appear on the Site and the new closing date will be given.
7. By submitting an entry, entrants will be deemed to have agreed to be bound by these Rules. Entries through agents or third parties will be invalid.
8. Only one entry per entrant is allowed and the Promoter shall be entitled to detect and remove any multiple entries (for example, but not limited to, an entrant using multiple email addresses). Automated or bulk entries will be disqualified.
Prizes, how to enter and the making of the Draw
9. The prizes consist of: 5 gold ingots (each being approximately 50 grams and worth approximately £1,000), 10 gold-plated Ipod touches, 2 gold-plated Playstation 3’s (80GB with DualShock 3 controller), 2 gold-plated Xbox 360 Elites and 10 gold-plated Xbox 360 faceplates. An entrant shall only be eligible to win a single prize. The Promoter may in its absolute discretion substitute cash value for a prize or offer an alternative prize of equal or greater value. The weight and value of the gold ingots are approximations only. Prizes can only be dispatched to addresses within the United Kingdom or Eire.
10. On accessing the Site, the entrant will be requested to enter their details on a form which appears on-screen. Entries must be submitted between the Start Date and the Closing Date as set out in paragraph 6 above. The Promoter will send an acknowledgement of entry although cannot guarantee receipt of such acknowledgement by the entrant. It is the entrant’s responsibility to ensure that a correct and accurate email address and telephone number is provided and the Promoter accepts no liability to the entrant in the event that the entrant provides incorrect information.
11. After the Closing Date, 29 entries from those valid entries received before the Closing Date will be drawn at random in the presence of an independent observer and the allocation of winning entries to prizes will be random. In the event that the Promoter subsequently discovers or deems a winner to be ineligible under these Rules, that entry shall be disqualified and a further entry shall be randomly selected and the new winning entry shall receive the prize that any disqualified entry would have received.
General
12. Winners will be notified by e-mail or telephone (using the email address/telephone number given on the Site) within 21 days of the Closing Date. Entrants who are not prize winners shall not be contacted.
13. All prizes will be dispatched to winners by courier organised by the Promoter within 28 days of the Closing Date. The Promoter accepts no liability for non-delivery of a prize.
14. A list of the prize winners (name and county only) can be requested within 2 months of the Closing Date by sending a stamped, self-addressed envelope to the Promoter (at the address set out in paragraph 23), marking the envelope “Call of Juarez (Prize Draw Winners)”.
15. Prize winners shall, if so requested by the Promoter, enter into any reasonable promotional activities required by the Promoter and the Promoter shall have the right, without any payment or further permission, to use a winning entrant’s name, town of residence and any likeness provided in connection with such related promotional purposes.
16. All entries will become the property of the Promoter on its receipt of them. Entrants to the Prize Draw agree that the Promoter shall be entitled to use entries as it sees fit without additional payment, permission or reference to the entrant, but always in accordance with the Promoter’s privacy policy, further details of which are set out at paragraph 19.
17. No correspondence will be entered into and the results of the Prize Draw shall be final and binding.
18. Entrants should not attempt to deliberately damage the Site or to undermine the operation of the promotion in any way or form. The Promoter will take any such attempts seriously and should such an attempt be made, the Promoter reserves the right to pursue whatever legal action may be necessary (which may include a claim for damages).
19. Entrants may be contacted from time to time in the future about new products, information or promotions which may be available from the Promoter. Any use of personal data provided by an entrant shall be in accordance with the Promoter’s privacy policy which is available at http://www.ubi.com/UK/Info/Info.aspx?tagname=PrivacyPolicy although if an entrant does not want the Promoter to use the entrant’s details to send communications or promotional offers in the future, the entrant may opt-out from receiving such communications by ticking the relevant box on the Site or by contacting the Promoter using the contact details set out at the above link or by clicking on the ‘unsubscribe’ option which appears in such communications.
20. The Promoter, in its sole discretion, reserves the right at all times to modify, suspend, cancel or terminate the promotion should any technical issue or unauthorised human intervention or other event beyond the control of the Promoter corrupt, jeopardise or otherwise affect the administration, security, fairness or conduct of the promotion. In the event of such modification, suspension, cancellation or termination, a notice will be posted on the Site.
21. The Promoter accepts no responsibility nor liability for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, or any lost/delayed data transmission (including entries which may be delayed for whatever reason to beyond the Closing Date), or any omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any website or internet service, or any other error or malfunction, or late, lost, incorrect or misdirected entries. Entry will be declared made by the authorised account holder of the email address submitted at time of entry. “Authorised account holder” is defined as the person assigned the email account by an internet service provider. If the Promoter determines, in its sole discretion, that there is any suspected or actual electronic tampering with the promotion or if technical difficulties compromise the integrity of the promotion, the Promoter reserves the right to void the entries concerned and/or suspend, modify and/or terminate the promotion. The Promoter does not accept responsibility or liability for any damage caused to an entrant’s computer system (including hardware and software) as a result of viewing or using the Site.
22. If any provision of these Rules (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of these Rules, and the validity and enforceability of the other provisions of the rules shall not be affected.
23. The Promoter is Ubisoft Limited, 1st Floor, Chertsey Gate East, London Street, Chertsey, Surrey, KT16 8AP, United Kingdom. Please note that, under no circumstances, should any entries be sent to this address.
24. These Rules shall be governed by and construed in accordance with the law of England and Wales. Entrants agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with either these Rules or the promotion.
