I would like to say a big, big thank you to Fermi, Blind as a bat and Debt Doctor, without them I wouldn’t have known where to start, thank you.
We went BR back in June 2008. After a very stressful year of juggling money, avoiding letters and calls etc.
On going BR we were allocated a female OR from Sheffield, seemed very nice and friendly on the phone when speaking to her, We though thank god, this is going to go better that what we had anticipated.
She went through the Income and Expenditure form agreed most of what we had put down, wasn’t too bad. My partners income changes due to a drop in overtime he could work so we went back to her in the July / August and a new IPA was agreed, at this point she told me the figures and I wrote them all down and seemed to be ok, didn’t check anything. I assumed that she knew what she was talking about and felt we didn’t want to argue too much, wanted a stress free end to a bad few years.
We also got a back payment of over £500 for Child Tax Credit in June after completing the end of year form. I immediately informed the OR who said it was all theirs to take, I was devastated, I think I even cried down the phone. Money as you can imagine was very tight before going BR, really could have used the money to buy things for the kids that we hadn’t been able to afford before.
After I was told I had to hand it over I logged on to this forum and posted the question, the answer was they couldn’t take it, I won’t go in to too much detail (unless asked) but it wasn’t theirs to take and after writing back and forth she still said no it was theirs and I agreed to pay.
When I did query this by letter and phone I was told a few different reason’s why they could take it. She blatantly lied to me with one excuse she gave.
I was the one dealing with all the money side of things and did at times get so overwhelmed I felt I couldn’t do it anymore. So I had decided to wait until our file was pasted over and try again, although I did pay the amount I made sure I didn’t pay all money we owed hoping I wouldn’t have to pay in the end.
Payments for the IPA and Nil tax where due to start in about October and it wasn’t until November / December but I though this can’t be right after paying what they require doesn’t leave us with the Expenditure she had agreed. So we decided to query this as well as soon as the file was sent over, realising we got no where before we thought we might as well wait.
I sent the first letter in February 2009 and after a few letters explaining what had been going on have now had confirmation that we were right on both accounts and only have to pay for the NIL tax.
Although we are now having a problem with that, his tax code has not gone back as we are now in the new tax year!
I know there are lots and lots of OR’s that are very good at their jobs. We were just unlucky, I guess.

It is rare, but not rare enough, i can think of several cases where the posters did not hve the fight left to argue, so the OR got what they where not entitled too, and that has always annoyed me.
So you have made my day, firstly for having the strength to question it, but more so for having the strength not to give up;):D
Lets hope other's find strength from your example, on the rare ocasions the examinor is wrong, you have shown it is worth standing your ground.

hi, just an observation on the 'tax' thing......I was told on my telephone interview that teh IPA would be the amount I would have paid in income tax [PAYE], had my code remained the same.....but that I wouldn't need to pay anything until my tax code went to zero.
{Apparently this doesn't always happen immediately.]
Also, that I may not recieve precise details as to where to pay the IPA until after my tax code gets zeroed...so I must put that money 'aside' until I recieve the details...
This seems to be very helpful of the OR....is this normal?No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -

I know of some that got a nil tax code and the OR never asked for it, the founder of this board (for want of a better way to put it, but if it was not for mike this board may not be here) was one.

They are not always on top of things, even after wrtiting to our OR it has not been rectified and I have had to give my Mum the cash to stop me spending it.

You need to contact your local tax office, not the OR. Only HMRC can change tax codes.0 -

OR's / examiners are there to be challenged if neccessary, whilst I believe most do a good job, there are increasing pressures to gain monies for creditors.

Its a good point and something i found out to that mistakes do get made i have to admit i am not one to take anything on the chin and when i discovered a mistake i went and contact the OR's office and asked to speak to a manager and after a good conversation was asked to email over a complaint. They do have a decent procedure and the matter was dealt with quite quickly as you might have read in my diary but dont be afraid to stamp your feet just because you are BR. You payed for the OR to do there job and of course they have to do there job but if you think something is wrong dont be afraid to ask or challenge it with an email or letter.:cheesy: K2nga :cheesy:
