So wanna be debt free!! (old debts)

If any one could give advice it would be appreciated!

I've lived with debts all my adult life.. i started when i left school and got a job and im now 29 and have debts from back in 1997 lol

i've managed with all my debts with payments i can afford and i've never been given a CCJ ect they have just take a income and exspenditure form and they have all been ok untill recent.

the company i have problems with call serve . my credit card had changed and as a result the automatic Payment diden't go though. and the company i was paying changed and from what i can see changed to call serve and then the fun began..

They have threatend me with CCJ ect and i've explained about my situation (self employed and feeling the pinch) and there not happy.

I had seen some posts about debts over 6 years old and tbh im totall confused and lost, and dont know what to do now i have asked over the phone for the original consumer credit agreement under the Consumer Credit Act, 1974 and they said they carnt provide it..

Any help would be appreciated

P.s i have 5 debts in total but the others arn't being a problem and are accepting the minimum payment!

    From what I've gathered, the 6yr rule applies when there has been 6yrs since the last payment or acknowledgement of the debt, not when it started. Also, i think you need to write for the cca, but there is a fee (£1 I think).

    Anyhoo, welcome!, and ((HUGS))!! Other peeps who really know their stuff will come along in a bit and tell you what needs doing

    I've found the CCA request letter from National debt line.

    Im gonna send off a copy recorded tomorrow and i'll keep you updated and thanks for the welcome..

    Well the check hasn't been cashed, i got a strange letter from Debt line so i called them and they have told me the lettor was sent in error, but while i was on the like i asked re the letter i sent to call serve and the explained they have the debt and callserve are the door step collection agency!

    But the request has now been sent to the Bank and the Debt is on hold untill the 1st of April


    I have 2 questions

    1. should i leave it of do a follow up letter for the credit agremment chasing it?

    2. should i do this to all my debts? as i now have another one (iQor) saying if i dont pay in full by the 10am on the 8th (sunday and there only open monday to sat)? it is a debt for a credit card tho.

    Its now been 14 working days since i sent the letter (recorded delivery) and nothing has happend on this end i have not had a reply, as stated in the last post they acknowledged reciving it and have forward it on to the bank but nothing has happend, i've checked the bank to see if the cheque has been taken out and it hasn't....

    What sould i do now??

    I can confirm both cheques have been cashed but still no contact and im well over the 14 working days for a response can i ask what does this mean because they haven't replied within the 14 working days specified?

    I think the law has changed and the 30 day+ letter is irrelevant.
  • Ahh first thanks for the reply :)

    but that changes things? If the 30 day is now irrelevant would that mean the debt is still enforceable?

    well I'll hold off on sending that letter then, should i just sit tight and wait for a response?
