Cut in holiday entitlement

The company I work for has decided to 'update' our contracts. My current contract has me down at 29 days holiday plus bank holidays. I signed that one 6 years ago. Over the last 3 years our entitlement has risen to 32 plus b/h, but this was not written into my contract.
Our new contract has 25 days plus bank holidays. Is my employer entitled to cut my anual leave in such a way? I haven't agreed to the cut and there has been no consultation at all. Ihaven't signed the new contract yet either.

If your company has been honouring 32 days + BHs for 3 years that is now your contractual entitlement. It was a change to your terms of employment to which it was assumed you agreed - given that it was an improvement (like you are assumed to agree to a payrise).

Do you have evidence of the additional entitlement? For instance do you have a copy of your holiday booking card which shows your manager's signature against a booking? That would show the new contract term even if you did not receive a revised version of your written particulars of employment in respect of the change.

Just as your agreement would be required in order that your employer could implement a pay cut, your agreement is needed in order to implement a reduction in your holidays too.

A reduction in holidays is also a reduction in pay as you would be working more hours for the same pay and thus for a lower hourly rate.
  • We have had a printed copy of our entitlement over the last few years, which show some of the dates we are required to have off (I am employed at a school) and the total days permitted.

Thanks for the reply by the way.
