a newie needing support, advice the lot please

am not a newie exactly, i did start off in the bankcruptcy thread but not really sure where i should be. i will try a short version though i am known to waffle. my husband left me a few months ago with almost £30,000 of debt all in my name!!! after the initial shock i got myself organised and applied for housing benefit, council tax benefit and child tax credit. thankfully i qualified for all. i am disabled and receive relevant benefits for that, dont work, in fact most of time not only housebound but for last 2 years room bound. my 22 yr old daughter comes to stay time to time and 26 yr old lives with partner away from home. so i have my almost 18 yr old son at home (also on disability but attending college). initially i did my SOA and it came to -£275 per month with little improvement with some help but when i did my budget with the CCCS they do not allow for the same things and they came up with +£322 per month and straight away re did budget and said i should go for a DMP did not have a very positive experience with them and found them not very sympathetic. my debt is made up with £15,500 to tax credit and the rest between 2 credit cards and a loan with halifax. inland revenue who are now paying me child tax credits straight away said i did not need to make any more payments to them as i was already suffering financially which was why they were now giving me money and said they did not want to make it worse by then taking some of it off me so would pass me on to a hardship team who would contact me periodically to see if my circumstances changed. CCCS syill however want to give them some of this mythical £322 i have surplus every month, which staright away doesnt make sense. i have paid a small amount to the other 3 explaining my situation and have already started getting charges but have let thme know i am with the CCCS. i went throught all the paperwork they sent me over christmas and can not see how i can maintain this £322 a month so rang them monday and spoke to one of the councillors who still unsympathetic refused to see how it should be a problem and when i mentioned bankruptcy see no it was not an option when i had surplus money every month why did i not just buckle down and get on with it. reluctantly she arranged another appointment for someone to ring me and go over my budget again although she could not see it making any difference. well, you are now up to date with me making myself sick with worry trying to work out what would be the best route to go down. when i asked on the other board if anyone had gone it alone and set up their own DMP with the creditors direct it was suggested i should pop on here and see if anyone could give me the benefit of their wisdomw. i really am at the end of my tehter not knowing what to do. i am not to blame for any of this £30,000, my husband is and yet i seem to be left with it. i dont mind having to pay half if i have to, but cant see how i can pay it all without really suffering for next 8 years which is predicted how long it will take to repay. sorry for going on a bit but hopefully this will give you all a in depth insight into whats going on and hopefully some of you may be able to gice me some advice, i do hope so please

    So sorry that you have had such a tough time lately. You can always try calling the national debt helpline. I spoke with them the other day and the chap I spoke with was so lovely and sympathetic I wanted to kiss him.

    Is none of this debt in your husband's name or joint names? Is the debt solely in your name? If you hubbys name is on some of it then he has to take some responsibility for the debt like it or not.

    unfortunately not much. some of the overpayments of tax credit was in joint names but only £6000, so eventually they will at some time chase him for £3000. but just a drop in the ocean compared to the rest which is in all my name. a further £8000 would have been in joint names too if it wasnt for the fact that the DWP messed up saying they did not receive marriage certificare so did not start putting his name on too until £8000 had already built up. spent 3 years disputing but i know i do owe the £8000 the additional £7,500 they only came up with recently saying i was overpaid every year since marriage too although i cant see how as we were not receiving any money from them but am waiting for a full breakdown of how that figure came about. although to be honest since they are no longer chasing me for money i have not been jumping on them for expanations, there just does not seem to be enough hours in the day. the other reason as well that i am feeling so snowed in is i am in constant pain with my back and even though on huge doses of morphine it does not help much and i get little sleep as wake so frequently with the pain i gave up going to bed 3 years ago. actually while writing this i do seem to remember from many moons ago a social worker saying i could contact them if i had any problems with money or form filling so it may be an idea to give her a call

    Did you post on the CCCS thread yet to see if one or "our" CCCS people could help you? They might be able to explain things better if nothing else.

    What about speaking to CAB or national debtline to see if they're singing from the same hymn sheet as CCCS? If they are then you'll need to have a rethink honeybun. If they see things differently then you've got yourself another option.

    What about talking to your GP? Our surgery can make referrals to debt advice people. (The CAB I think)

    You could try posting your SOA again to see if fresh eyes see things differently. Wasn't there some confusion over listing debts that would have to be covered by CCCS's remit?

    But please try not to make yourself ill fretting about all this.

    The worst case scenario is probably that you go bankrupt - which isn't actually all that bad when you think about it.

    Can your daughters come round and help you out with things? Someone to talk to can make it all seem much less scary.

    figures in red are the new benefits i have started to receive since last posting on here (think i may have answered own question, no doubt new benefits are reason for hike in available funds) still seems very strange to insist on paying someone (inland revenue) when they have said not to for time being anyway i receive dla and ib and my son gets dla too for himself i live here with him 18 and daughter probably here 14 out of 30 day month

    thanks jacks, yes i will try and ring one other agency today, even if that is all i can mange. am really having problems trying to cope with all of this and the constant pain i am in. its like a full time job. when i had it all laid on bed last night i just sat and cried, there is just so many things to think about and people to contact.thank god all i have is 4 creditors. well i say 4 over christmas i got gas and electricity bill they now total nearly £200 so dont know now whether i have to think about adding them or if i should take money offered by mum to pay half i can raise the other half so i have them out of the way for time being or set up a DD with them which initially will be for double the normal monthly sum so that when the next quater comes along the money for that will be there already or pay them now and then set up DD so not in same boat next quater. should also probably check if i am getting the best deal with them anyway!!

    since completing my last SOA i have had some more bills in and rceived some benefits and not sure which to put where. for examaple i receive housing benefit now so do i still put my rent charge down but put my housing benefit in as income or do i just put nil for rent charge. i also have arrears now on rent, gas and electricity so do i just down my new DD amounts as companies have increased these or do i need to put the total arrears in my debt to creditors bit like i now have £346.06 in renta arrears so do i put that as what i owe to creditors or just put the increased DD payments in the monthly outgoings, getting really confused. also i am sure that the CCCS are using my DLA as an income and it is not to be counted as such as it is not supposed to be put in as an income as it is not meant to be used as household income but to be used as additional help with income travel, incontinence pads etc so do i put it in my income bit or not. plus would a debt advisor who is geared towards helping people with disabilities perhaps be more understanding than CCCS as they would understand some things like incontinence pads are not a luxury but an necessary evil. i do have an new appointment to go through budget with CCCS but cant see that helping if they do not move the goal posts a bit on what can or can not be taken into consideration in the my day to day expenses. sorry so many questions but spent all night again with it all running around in my head and already had a bad night with pain to contend with. i even received a letter yesterday from halifax charging me £10 for a call they made to be at 7.50 AM NEW YEARS EVE to ask why i had missed my payment. i have only missed one payment and even though that is all that has been missed after 3 years of payments not even a day late and ringing them giving them info and reference number of CCCS and a good will payment made i cant beleive have already had a £20 charge incurred and now this £10 call charge. they certainly dont let the grass grow so i have to get this decided one way or another this weekend so i am up and running monday signing up to whatever action plan i have decided upon?
