Phone calls

Hi,

I've read a few bits on these boards about getting companies to take your phone number off their system to stop the chasing phone calls under the data protection act. I've just tried it with Barclaycard who phoned up this afternoon and they say as my account is in arrears they have a legal right to a phone number so they can keep chasing me and they won't do it. You can only get them to remove the phone number for marketing purposes. Is this right ?

    There is a letter somewhere that you can send them telling them you only wish to be contacted in writing. If they continue to phone you after that then it will be classed as harrassment. Hope someone can provide the link for you.

    Sadly yes..........You can have your phone number witheld from being used for making sales calls, but not if you owe any company money!!!!!!

    Go to www.oft.gov take a look at the Debt Collection Guidelines and check out your rights. You can ask for all communication in writing if you like, they cannot refuse this.
    People like us, in debt, have a lot of rights! They are based around being treated in a respectful and reasonable way.

    Dear Sirs,

    RE: Credit Card No xxxx xxxx xxxx xxxx

    I refer to my correspondence of (date) regarding the debt that I owe to your above named client. A copy of this correspondence is enclosed herewith, for ease of reference.

    Since making my financial position clear to you, I have been constantly harassed by your operatives, who have attempted to intimidate me into making payments that I simply cannot afford to make, under my present circumstances.

    I wish you to know, that I am aware of my rights and that your constant telephone calls are a breach of Section 40 of The Administration of Justice Act 1970 and any further incidents of this nature constitute a course of conduct, which is a criminal offence under Section 2 of The Prevention from Harassment Act 1997.

    Please note, that whilst I take my obligation to you seriously, I will not tolerate such abuse and if I receive any further telephone calls from your organisation, I will have no hesitation in reporting the matter to The Office of Fair Trading, whom you may be interested to know, are currently encouraging reports of this nature.

    I would be obliged if you would kindly acknowledge receipt of this letter and confirm that there will be no further attempts to contact me by telephone. I am entirely happy to communicate with you in writing and would be obliged if you would give my proposals, serious consideration.

    Dear Sir,

    With regard to the above account, I am not prepared to discuss this matter unless it is in writing. I do not wish to receive any more telephone calls regarding this matter.

    If you contact me via the telephone I will view it as harassment and you will be in breach of Section 40 of the Administration of Justice Act 1970 and the Protection from Harassment Act 1997. You would also be in breach of the Communications Act (2003) s.127 and I would report you to OFCOM, Trading Standards and the Office of Fair Trading, meaning that you could be liable to a substantial fine.


    Please also be advised that all calls are now being logged and recorded.

  • Glad That I found this - we're going through CCCS at the moment, and whilst proposals and offers of payments have been made to our debtors we're still getting calls, despite asking them to correspond in writing only. We're going to send a copy of this letter to them, hoping they'll stop! We have my parents staying for a a couple of weeks, last thing we want is to have to try and field calls with them around!

    When any one rings , refuse to confirm the security details . State firmly that you do not discuss financial matter on the phone . Then just put phone down . I was gettin two aday from car boot , I just put phone by the tv so they could listen to Balomory !
