Terms and Conditions

There are two Prize Draws: Prize Draw 1 and Prize Draw 2. Readers may enter either or both prize draws as long as they submit their entries before the respective closing dates below.
By entering into these free Prize Draws entrants agree to these terms and conditions and acknowledge that failure to comply with them may result in disqualification.
The Prize Draws are only available to UK residents. Entrants must be over 18 years of age. Employees and immediate family members of employees of either BBC Worldwide Ltd, The Wrigley Company Ltd and their associated companies, professional advisers, advertising and promotional agencies are not eligible to take part in the Prize Draws.
To enter the free Prize Draws, entrants must fill in their details on the website 'www.topgear.com/airwavespro' and submit by the 14th of July in the case of Prize Draw 1 and by the 18th August in the case of Prize Draw 2. Only one entry per person is permitted. Multiple or incomplete entries and entries from third parties will be deemed invalid.
The winners of Prize Draw 1 will take part in the competition which will take place at Silverstone Circuit, in Northamptonshire, NN12 8TN, England, on 19th July. The winners of Prize Draw 2 will take part in the same competition on an as yet to be confirmed date in early September 2008. Travel expenses to the event and accommodation are not included in the prize.
BBC Top Gear magazine shall notify the selected winners by email within 3 days of the Prize Draw. If the Prize is declined or unclaimed by a winner, or if a winner cannot be contacted from the details supplied within 3 working days of notification or if a winner does not confirm his and his/her guest's attendance (and names) within 3 working days of the notification, a replacement winner may be drawn at BBC Top Gear magazine's discretion and will be notified by BBC Top Gear magazine. The original entry that was drawn will then be forfeited.
The Prize has to be taken as offered. There is no cash equivalent to the Prize available and the Prize is non-transferable.
By entering the Prize Draw, you agree to take part in any publicity relating to the Prize Draw by BBC Top Gear Magazine, if you are invited to without further compensation. The winners' names will only be used on first name basis to protect their identity.
BBC Top Gear magazine and The Wrigley Company Ltd reserve the right to cancel or amend these Terms and Conditions or change the Prize (to one of equivalent value) as required by the circumstances.
Neither BBC Top Gear magazine nor BBC can accept responsibility for or liability arising from participants taking part in the Prize Draw or for the Prize and The Wrigley Company Ltd cannot accept full responsibility for the same. BBC Top Gear magazine gives no warranty or guarantee in relation to the Prize.
To the fullest extent that may be excluded by the law BBC Top Gear magazine accepts no responsibility for or liability arising from entrants taking part in the Prize. All activities will be undertaken at the participant's own risk. BBC Top Gear magazine gives no warranty or guarantee in relation to the Prize nor any guarantee as to the number of entrants who take part in the Prize Draw.
Every care will be taken to ensure the safety of the winners and his/her guest, but BBC Top Gear magazine will not be held liable for any death, loss, injury or other liability that results in the winner and his/her guest's participation in the competition at Silverstone. The winner and his/her guest will be required to sign Silverstone disclaimer forms before permission is granted to drive and must comply with all driving instructions given at the event and the Silverstone track rules. Top Gear Magazine and The Wrigley Company Ltd reserves the right for the track instructors to cancel the event or refuse any driver permission to drive where required for safety reasons in exceptional circumstances, e.g. adverse weather conditions or health / fitness of driver.

These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with this Agreement shall be subject to the exclusive jurisdiction of the English courts.
Promoters rights: No alcohol can be consumed prior to or during the challenge and the promoter reserves the right to refuse a driving challenge to persons suspected of being under the influence of alcohol and/or drugs. Entrants should be aware that the very nature of the driving challenges means some personal risk may be involved. Please note some medical conditions preclude certain drivers from taking part in the challenges. Silverstone Ltd has third party and public liability insurance cover for all their operations and provides those taking part in driving activities Personal Accident Insurance. Entrants must agree at all times to comply with all applicable health and safety legislation. Prior to the commencement of the promotion, entrants must sign a disclaimer of liability. Until an entrant has signed such he/she will not be permitted to participate in the challenges.

The promoter may: i) extend any time limit; ii) waive any of these Terms and Conditions where a person might otherwise be disqualified (without obliging the Promoter to relax these Terms and Conditions in any other case whatsoever). The Promoter reserves the right to alter, amend or withdraw the promotion or any part of it without prior notice or compensation due to circumstances beyond its control. The Promoter's decision shall be final and binding and no correspondence will be entered into.
