1st Credit - Now recieved statutory demand

Please forgive this as my first post, but I searched 1st Credit and this came up very quickly.
I too and am having big problems with 1st Credit and their bullyboy tactics:mad:

I have just rec'd a Statutory Demand from them and am unsure what to do now.

This is an old Barclaycard debt to the sum of £3,332.

On first contact with these people about 6 months ago, I sent in my income and expenditure and my token offer of £10 per month. This was rejected in writing, and I can't go any higher:confused:

I carried on making the token payment each month over the phone and as the person above has stated,they are a pretty horrible bunch with constant threats to me of CCJ, attachment to earnings, bankgruptcy proceedings, land registry nosing about etc etc.
(I do have a mortgage btw)
I would normally just hang up on them.
And they even sent me info about a re-mortgage company, which I have of course ignored.

So now I get this Statutory Demand.:confused:

Any help?

It says something about 18 days to do something.

  • Hi lifeisHard - Sorry to hear you are also having problems with these Bullies-

    I would suggest starting a new thread as you will get some great advice- they havent even acknowledged my offers of payment.

    It seems the general opinon is that the demands are a bluff HOWEVER there have been cases when they have followed through. My stat demand only gave me 7 days to respond.

    Do you have proof of payment?

    If you havent already document the contact you have had with them-

    My advice would be to not deal with them over the phone and get all dealings in writing.

    Sorry I cannot give you any more advice or reasurance of what may happen - I will keep updating my story and it helps me keep track of what is happening.

    Can we check a few things?

    Before your heard from 1st Credit, how long was it since you last made a payment on this debt or acknowledged it yourself in writing?

    Sometimes these debts are statute barred.

    That normally applies if there has been a 6 year gap, even if you start making payments after the six years was up.

    If the debt is/was not statute barred, then you should request a copy of the original credit agreement ASAP. Letter to send recorded delivery with a £1 postal order in the link below.

    If you get that off quickly, non-compliance with the request may give you additional grounds to get the SD set aside.

    Because a Statutory Demand is a serious issue, even if you are fairly confident they are bluffing, please contact National Debtline as soon as you can for advice.

    Some further info:

    Proof of payments comes in bank statements as all transactions have been made by card.

    Before 1st Credit got this there was a break of about 4 months as the debt was passed back to barclaycard from another company,that I could not keep up the payments with. I tried and failed as I would guess a lot of people like myself just overstretch what they can afford to pay these companies.
    When they said no to a lower payment, I stopped paying them. Thats why it went back to barclaycard who then after 4 months got 1st credit involved, who have this "we are going to crush you" attitude.:rolleyes:

    I will call the national debtline for further info, and thanks again.
