Bankruptcy or Not?

Hello, I am looking for some advice about my current debt situation. I am currently with payplan on a debt management plan with my husband. We owe £43921.78 and we have a £113000.00 mortgage and a £16000.00 secured loan and we also pay £278 a month for a £14000.00 loan a friend took out for us to help. I know oh dear, its a devestatingly high amount of debt. I am 26 and my husband is 30. This is our monthly budget -

We both have 2nd jobs but as they are not guaranteed income, Payplan have left them out. I think also because of the loan with the friend which I was desperate to keep paying, they have not taken the 2nd jobs into account. We have an extra £100 after we have paid this loan. My husband owes his Dad £5000 and he usually gives this to him, even though I disagree with it, because we desperately need it to be going elsewhere. Anyway, the above budget looks OK in principle, but in the time we have been on it its not worked out like this because we both have these damn pay day loans that we keep refinancing which I have one for £300 and my husband one for £100 so this keeps messing us up everymonth and not only that its costing £40 quid a go everytime we do this. This month, we literally had no food and its not been the first time. I have been trying to deal with our debts since my early twenties and I just have come to the end of the line, I feel shattered with it, and whilst it doesnt seem to bother my husband (generally if he has a beer in his hand he is happy) I just dont know how long I can keep living like this, I feel the whole of my youth has been spent on trying to get by. I have nearly finished getting the house ready to sell, because we cant afford to keep it. I dont know if it will sell in todays market and where we will even get the fees for the Hip pack etc, but I guess we will find it somewhere. My problem is I want to leave my husband, all the stress over the years have played a massive part in our relationship and I feel very bitter towards him these days and feel I want to be on my own. But I dont think I can afford to go anywhere because of the mortgage and joint debts etc. I am considering bankruptcy. Can anyone please offer any advice? Thank you x

Hi .. you need to talk to CCCS, national debtline or your local CAB first if you are considering bankruptcy .. they will give you free impartial advice.
The judge may ask if you've taken this advice and can potentially refuse your petition if not!
Speak to them and also ask any BR specific questions over on the BR board... the people there (like here
) are very friendly and will help in any way they can!

Is the loan to you friend included in the lsit above?

Thanks for all this. No the loan isnt included on the list, thats the list Payplan drafted up for us. I think we should market the house... for (I keep saying house, but its not its a flat!!) The flat for £120,00.00 but I reckon we will get offered around £115,000. It was valued at £120,00.00 2 years ago when we remortgaged.. Thanks..0 -

Yes he is OK about selling up too, he knows we havent any other choice because we are struggling so much. Value of our mortgage is 113,000.00. But with the secured loan 16,000.00, which means we will prob be in negative equity...

Thought it might be handy to say that out off all the debt that payplan are currently helping us with we have two joint loans

Oh Louise what a mess BUT you do have a good income. How much will rent cost round your way for a one bed place? I know you are thinking about splitting with dh. I can understand how your feeling towards him are worn but you know it might not be an un-savable marriage... As you say you have been under soo much pressure for so long you cant think straight. I would be inclined to be honest with dh but try and hang in there you now have a plan to try and sort the problems out that are shadowing your relationship and once those problems have gone you will be able to focus on what's right for you. Now you are in too deep with the debts to have a clear idea of what you really want long term.
Can you rent a room out in your place while it on the market?
You need to get advice from cccs or pay plan about the implications of going BR too.Debt free and plan on staying that way!!!!0 -

What have you got that can go on e-bay, amazon or to a car boot sale? Aim to clear your loan this month and cut into OH's if possible.
