I have been offered a new job. my current employer only provide a very restricitve reference i.e. only included how long i had worked for them. additionally i had to tender my notice before they would issue the reference,. as a result of the lack of information i was asked to complete a medical questionaire. now their occupational health advisor has asked for a report from my doctor.
i now realise that i have handed in my resignation but not formally been offered the other job in writing, my employers are being cagey about whether i can withdraw my notice if my new employer does not like what is in the report from my GP. By the way I do have some health issues.
what is my legal position now

It depends on what the health issues are, is it likely to affect your ability to perform the job, I don't mean that as necessarily meaning you won't get the job. A good employer will recruit the right person based on ability, etc., but if you need, just for example, to always work on the ground floor, then an occupational therapist will be able to advise them.emmahughes wrote: »what is my legal position now

what do you mean by 'dubious posts'. i thought this forum was for genuine queries on any of the subjects listed. so i registerd and left queries about two problems i am having in my life at the moment.
and what do you mean by 'left 2 posts within 6 minutes and left after 10 minutes'
maybe you've got time to sit in front of your computer for hours on end waiting for someone to reply to a query but i do not with a full time job two children and a disabled partner. if you cannot be helpful then don't reply it is simply pointless.0 -

It depends what it states is in the contract of employment CFC.
My line of thought on this was leaning toward a potential claim for constructive dismissal if employed in excess of 12 months.

That was where I was leading too, Standupguy, if OP has been in employment for more thatn 12 months I thought she might have grounds to claim constructive dismissal but I hoped some of the HR/legal types would come along, this is definitely not my area.
Emma, just to say in defence of premier, from time to time spammers sign up and leave a couple of messages then disappear, they sometimes then either log on as themselves or create a second ID and respond to their own emails with web addresses and the like - they are just trying to drum up business. It does seem to be a bit of a problem on MSE but I am quite new too.

just to let those who gave helpful advice know my job offer has now been confiurnmed without the need for a medical report and i start on 4th August. Thanks again.:T0
