Upon reading another thread I am unsure as to whether this is the CCA or an application form?

It says in the siggy box " this is a credit agreement regulated by the consumer credit act 1974. Sign only if you want to be legally bound by its terms"

So is this an application form or a true CCA?

    I am so confused

    LM

That's the exact wording of a CCA (I used to issue them for a Bank).

Not sure what else to offer for advice but if it were me I would want page 2, because if a Credit Agreement is made up of 2 pages then the whole thing is the CCA.

I would also want to know how the figure of over a grand has been arrived at if you only borrowed up to £250?

That's what I would be asking for I think.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

i believe to be a true copy of a credit agreement it has to have certain things contained in it. One of those is the signature of a rep from the finance company otherwise it is an application and only becomes an agreement once all parties have signed. many companies send out copies of application forms and not CCA.

No doubt Rog or others will be along soon to put you straight.

So summarising they have not done it within the time restrictions and only provided page one of two, so far they have not done too well see what OFT say.
  • Thanks Dave but this also has a sig by (from what I can remember) the sales person on behalf of Time Retail Finance, it was signed there and then the same day as I signed.

So I guess it is all over for me then. Back to having another debt round my neck and these leeches bleeding me dry for the next 20yrs!!!

I remember getting a Timecard - which should of had the relevant info with it but as it was 12 yrs ago I cannot rememberwhat came with it.

If this debt is over 6 years old, why are you not using the tatute barred option?

Was there any period in the last 12 years during which you did not pay for a period of over 6 years?

  • Thanks Ras but I have paid them from March 2004 until Nov 2007 - when I disputed the debt

And how long was the gap in payments before March 2004?

  • Probably about 4 yrs so again it is not long enough

I remember we went onto a debt management plan in 1998 (fix all your probs kind of thing) so that would have ended in about 2000

I don't recall paying anything further until I got a letter from the DCA which when I saw it was on behalf of Time Retail I knew it couldn't have been settled so I started paying what they had asked for.

    Ok
Can you post up a scan and then pm weller711 or smashedbooboo to come and work out if it is a CCa or an application form.

Even if it says Credit agreement it is not one unless it has certain specific elements.

Is there an APR on it anywhere?

  • No APR anywhere, I tried to scan it today but my scanner wouldn't work so I uninstalled it and now it wont re install
