    Chris speak to ACAS.

With regard to your Union - contact them say that you were unable to pay the subs as you couldnt afford it due to being on long term sick and that your rep hadnt advised you that you switch to suspended subs or reduced subs and that you had no choice but to quit..appeal to their better nature and see if they will take you back on especially as this is an ongoing problem at work and you have been represented before.

It is correct when the GP says that the company have to write to him and that he cannot write directly to them himself.

Ask the manager for a copy of all minutes of meetings that you have attended where your performance has been discussed - you are entitled to these anyway.

Swearing at people hasnt helped - even when they are rude to you, you have to grit your teeth.

Do you have a copy of your grievance procedure? If not ask them for it - as you have submitted the grievance they need to investigate and come up with an outcome and they have to do this within the time frame noted in the procedure.

If you feel unable to continue then you could try the employment tribunal for constructive dismissal - depending on your length of service. Remember that there is a 3 month time limit from the date of the last incident in which you can submit a claim to the employment tribunal..no reason why you can't start the process now because you can always postpone it further down the line.
Thanks a lot, they`ve rung half an hour ago asking if i`d been to doctors yet for the info on my injury etc. Then we can get you back to work.Told them the day after being sent home about them writing to doctors and they still don`t.Been told off union ACAS and citizens advice and you that that's the correct procedure.

But in that meeting yesterday they kept saying that there`s no set job and couldn`t guarantee that i wouldn`t be put on the job or end up being put on that job later in the day.So don`t know what they`re game is probably want it to be negative in what i can do so they can sack me capabillity wise.Which after all whats happened wouldn`t upset me too much, as they have to pay me a weeks notice for every year.(been there over seven years)
Either that or they want to get me back to fire these charges they reckon to have against me.

Some of these things i`ve meant to have done can only be from months or even years before the august incident.

My girlfriends dad is a union branch secretary for another company, his opinion is that they can`t try me for that in august or any of the others as they have to be dealt with when they happen, you can`t just store them up.

Going to do all you have suggested, grievance procedure says go to line manager then manager then to md.Or straight to md if it`s about the manager which i did as it was about manager,he just passed it down.

Learned the swearing thing the hard way,but it`s hard when someone swears and talks down to you.In future have to take deep breaths and revel in the fact that me not reacting and giving him what he wants is winding him up

Your posts make no sense to me. I'm assuming you don't use English professionally.

Okay - you need to start with a letter clarifying your position. This puts things down in writing and formal, but you need to clarify some things in order to get meaningful help.

You state that you did send in a grievance and that this was in relation to being told to go home as no job available for you. You then state that you attended a meeting yesterday and were informed that they took notes at the meeting in August - which I assume is the one you were told to go home?

In the meeting yesterday there seems to be a change of tack in that you are now being told you are being rude to staff - I assume that you were not shown any evidence to substantiate these allegations? Although you do accept that you have sworn in the past - do other staff swear too? Has anything been said to you/other staff regarding swearing in the workplace before?
Finally have you taken notes of the meeting? Was it you and one manager or a number of other people?

Give the responses to these and you may get more constructive assistance. For example I would ask for copies of the notes by return as if they are there it will only require photocopying. I would be advising that I was sent home. Would also inform the company that I am willing to see a company doctor and/or sign authorisation for the company to contact my gp to get information about my disability.
However, how I would do it does depend on the information being accurate and as clear as possible from you.
It`s always been supervisor and manager and just me.never took notes as meeting in august wasn`t official according to them. You assume right about meeting in august.

Yesterday in that meeting the manager said i`d admitted in the august meeting that i swore at the supervisor which i didn`t admit too.He then went on to add we`ve got more instances of you being rude to supervisors with witnesses which are either from way back in the past or made up.When i asked about this they wouldn`t tell me and said we`ll deal with it when you return.

Everybody swears, some people call the foreigners loppy b*******,and they return the favour. The supervisor swore at me in august first.even the production managers swore at me before saying i was talking b****** during an occasion when he came up screaming at me.Nothings been said to me about it before. The hand book used to say swearing should be kept to a minimum. Not seen it for a while they might have changed it to spite me.

Advised i was sent home manager said he didn`t yesterday. His exact words in August were "go home, make an appointment with a doctor then bring your sick note in if your not fit for work, you could be making it up for all i know".

There isn`t a company doctor, they asked me yesterday to get doctor to send some information but last time doctor said get company to write to me,told rhem that back in august and they just ignored it.They rang about an hour ago asking if i`d got doctor to do it yet.

OP your posts do not make sense.

When you write them read them back and see if you can make sense of them yourself before posting them. Then edit them until they make sense. We can't help you if we don't understand what you are writing.

Also can you tell us what is your arm condition? It maybe of use.

In addition when you have a meeting with management make sure that someone who is a recognised union official is present whether it's your girlfriend or not. That way management cannot use the meeting to talk about something it is not intended for.
    I'm not cynical I'm realistic :p

It is tendon damage in the upper arm which connects the bicep to the shoulder.Having mri scan this Wednesday coming and possibly surgery.

Sorry if people can`t understand, but hard to explain when a lots happened and with it going back to august.

In all meetings never given option of taking someone into it. In the meeting in august told it was not official.

For the meeting on Wednesday the letter just said could you attend a meeting. No option of bringing anyone and i thought it would just be me and the manager, not two against one.
