Council have taken our money illegally

Hi
Advice please

I have been a leaseholder ( Right to Buy) in a block of flats in Westminster for the past 21 years after being a tenant for 7 years. During the 21 years as a leesee our service charge for the year included £180 for the Caretaker's rent. This amount they had taken for the past 21 years.

We have been challenging the Westminster Coucil( our landlords) over the years that we should not be paying for his rent. They disagreed. Two months ago we had a letter from the council saying that they have been told that it was illegal to have taken this money and were waiting on a court ruling.

Now we have had our refund ( paid back the money they illegally had taken from us) but only for the past SIX YEARS. They said that under the Stauary limited they don't have to pay us all the money they illgegally had taken from us. That means they have kept money for the previous 15 years! Suely that can't be right? It is theft!

Any help on this matter

Thank you

Paul

If its illegal then you should report it to the police. If its unlawful, which is more likely the case, then you should refer your case to a solicitor to see what they think.
