    Hi Guys,

Just thought I would give you an update to my situation.

As of 15th June 2009, I issued a SAR request to Abbey including a cheque for £10 which was cleared approx. 2 weeks later.

I should have a response from Abbey shortly (within the week). Does anyone know what my next steps would be should Abbey fail to respond?

Also, if they do respond, I am looking for the default notice (or letter to that effect?), does anyone know what one looks like?

On a more happier note, I've started the whole "getting onto the property ladder" shin dig, hopefully find out tomorrow if I am accepted for a mortagage in principle.

My IFA has said that the default on my credit file might affect things but hopefully not.

So the happy feeling didn't last long. My mortgage in principle was declined due to this default notice.

Abbey have a week left to respond but does anyone know if it would do any good me calling their Customer Services?

Just wanted to bump this topic as I'm keen to get some advice as to what my position is.

I've just got off the phone to Abbey Customer Services (who were actually rather helpful!) and have said that my account information can't be accessed becasue it is so old, so I would need to write to them (as I have above) in which case they may be able to resolve the issue.

Interestingly, after I mentioned that technically I am now a customer of theirs as I bank with A&L, which is now part of the Santander Group, they were even more helpful!

Ok, one last point, I have checked my Equifax report which only has a "delinquent date", but no default date! so either I am looking in the wrong place or Experien and Equifax are showing two different things.

    hi tom

any news from abbey? did you get any SAR reply at all? that would be a start point so you can see what went on.
Failure to send you a valid DN could be a breach of the CCA, and now they seem to be in breach of the DPA for failing to respond to your SAR. If you need any help, I will try my best.
I got Judgment by Default against Abbey since they failed to file a defence, but sadly it means very little because they will request set aside of that judgment, which will be granted. 6 months so far, still nothing from the ICO or FOS, and no hint of a move from Abbey...so its off to court we go!
I bet you cant wait for all that to come!

    Hi Jon,

Nothing from Abbey in terms of the SAR, not even a letter saying they are dealing with it.

NiD's latest letter (#941 here) got a response (#1057 here) by which they have either today or tuesday to respond to, in their own words 15 days, or if they need longer, they will let me know.

I guess they just think I will forget about it, however I am desperate to get it sorted out before the new year as i'm hoping to be buying a house in Feb 2010.

I hope it doesn't come to court action becasue, by the sounds of your battle, it would take an age to get anywhere.

Do you know what the next step would be if Abbey fail to respond to NiD's letter? LBA? C&D?

    Cheers for your help,

    Hope you're good.

    Tom
