don, know what to do now with court being Adjourned, any advise what happens next ?

To cut a long story as short as possible, bought a couch of dfs with (ge money) they took 2 payments last year on the same day and made me go over drawn, which the bank charged me £35.00 for :mad: i queried this but they say the didnt, sent them a bank statement they said they never recieved it even though recorded delivery, next thing they sold the debt on to CL Finance Ltd, where they couldnt comment on th situation why 2 payments came out on the same day, there response was see you in court, so yeterday my husband and i took a day off work (lost money we could ill afford :mad: ) when they gave the judge her statement it was down on them that they had taken two payments, also that we had charges from them for not having enough money in our account, dont know how they worked that out, she asked Howard Cohen solicitor why did this come about, he did not know why, she wanted totals of how much we had paid and charges he didnt have them, so for half hour the solicitor was struck dumb, so she said we will adjourn case while he gets the answers, so what happens in the mean time, never been to court before so dont no anything, sorry for this being so long. Any advice out there please,

    OK. They are the Claimants then.

    What did they take you to court for? (From your post it seems they took 2 payments from your account, causing you to get bank charges etc - so how did they end up taking you to court over unpaid money?)
  • We were only half way throug the payments when this started happening, then no payment was taking after that they just sold the debt on, never had any problems with debt in my life but i bet you i will now, even though we have lived at same address for 21 years .

    As far as the adjournment goes, ring the court and see if they can help you by confirming to you exactly when the case is to be heard, so that you don't miss it and lose out just because you don't attend.

    If you haven't done so already, you may like to get some advice on this (eg from the CAB). Take all the documentation you have and discuss this with an adviser.

    If the case against you is thrown out, ask the judge if you can be reimbursed your expenses and loss of wages for the two court hearings you will have had to attend. If the judge agrees, then the Claimant will be ordered to reimburse you.

    " it is ordered thate that the claimant do file and serve by 4pm on 11 February 2009, a full financial statement showing running balances and full explanation as to the entries."

    We have had not correspondance from the claimant at all, so what does this mean?

    Never been through anything like this before, sorry if i seem a little dim. I am the defendant by the way

    The court has told the claimants (the bank or CLFinance?) to provide evidence to the court to justify their claims, and given them until the 11th Feb to do it.
