Hi
Been with payplan now for 3 months, all of my creditors have now accepted this DMP, although I did have trouble with a few of them....but they come round in the end.
Now I am having a lot of trouble with Mercers/Barclaycard. They are refusing to accept my DMP and phone constantly, saying that what we pay is not good enough. My paypal advisor has just told us to ignore them, and it will be better if they sold the debt on.
So this morning we get a call from Mercers, the 3rd call in 3 days, to which my G/F blew her top and told them that they will get what they get, so they have now threatened us with a door collector.......my G/F told the operator to send who ever they like round.
any advice would be appreciated here....I will be phoning Payplan on Monday to ask advice.
Oh, I have requested a CCA from them, sent that today.

Hi Adam
Send them this letter by recorded delivery:
Please be advised that I am only prepared to communicate with XXXXXXXXX in writing. OFT rules and regulations clearly state that you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.
There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; e.g. the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).
Therefore take note that I revoke license under Common Law for you, or your representatives, to visit me at my property and if you persist in sending "doorstep callers" to my home, you will be reported for harassment and be liable for damages for a tort of trespass.
You would also be liable for conspiring in a tort of trespass by acting in defiance of my instructions and sending someone to visit me nevertheless.
Should it be necessary, I will obtain an injunction
ONLY PRINT YOUR NAME - NEVER SIGN
One thing to bear in mind, these people who are calling you operate from a call centre and are working to targets, it's useless tellomg them anything, there not interested, when they call, just hang up.
Just another thought, you could also include this letter:
DAC / Creditor's Address
Date
Ref A/C xxxxxxxx
On the top of your letter state very clearly in big bold letters “FORMAL COMPLAINT”
Dear Sir / Madam
I refer to the above account, held with yourself's.
I have informed your company on numerous occasions I am experiencing financial difficulties.
I am acting in a responsible manner re my current situation, by seeking the advice from XXXX, I have informed your company of this, which has fallen on deaf ears.
Due to the continued harassment I'm experiencing from your company, I have taken advice from the OFT, I am informed your company is in breach of the following guidelines:
Deceptive and / Or Unfair Methods.
2.8 Examples of unfair practices as follows:C: Refusing to deal with appointed or authorised appointed third parties, such as, Citizens Advice Bureau, Independent Advice Centres, or Money Advisor's.Contacting debtors directly and bypassing their appointed representatives.
I have informed your company, that (give the name of the organisation and account number of whose managing your DMP), is my authorised third party appointed representative. If I do not receive a satisfactory reply to my complaint from your company within 7 working days, from the date of this letter, I reserve the right to refer my complaint to the OFT for adjudication.Sit back and see what happensClick here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

Hi 10past6
Thank you very much for your help, I will send both of these letters first thing Monday morning.0 -
I hate Mercers with a passion!
Don't wish to scare you but they sent a doorstep to collector to me although I'd been on a dmp with CCCS for several months. They refused to accept it at the time. However, I sent the doorstep meat head on his way (I'm female and live on my own!) even though I had sent a letter asking them not to and a telephone harrassment letter, they still persisted. Since I complained to the world in May, they've been quiet and finally accepted my dmp (dmp been in force since January and all other creditors have been ok).
They even tried to get "crafty" with me and started sending me texts to my mobile pretending to be friends to get me to ring. They must think I was the local village idiot!
Since my complaints, it's all gone quiet and they have accepted my dmp. Silly thing is, they are one of my smaller creditors and gave me the most hassle!
Good luck with them.Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free

Don't forget - with doorstep collectors, they have as much right to enter your property or to take your goods as the paperboy - none. You don't need to let them in and if they refuse to leave after you have asked them to do so, they are trespassing and you can have the police remove them. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
Dad Gift 6k ¦ Savings & Inv Tst: £2,500
Loan 10k: £0 ¦ Dad 5.5k: £2,270 ¦ LTSB: £0 ¦ RBS: £0 ¦ Virgin £0 ¦ Egg £0
Total Owed: £2,270 (+6k) 11/08/20110 -
Hi
Got another call from them today, My G/F confirmed her name but wouldnt confirm her DOB, so the operator couldnt continue with her call and ended it.
I have had enough, I have called my phone operator and have changed my number from tomorrow.......that will put a bee in their bonnet!0 -
I just ignored them when they constantly rang me.
As George says, they have about as much right as the milkman. Do not let them in (in fact you do not even have to answer the door to them). I left the guy standing on my doorstep in the pouring rain for 20 mins whilst I had my tea! If they refuse to leave, call the police.
These guys will spout all sorts of stuff at you to get you pay up. Tell them to bog off!! They are full of hot air and get paid on a comission basis so will do all they can to get money out of you.
Mercers were the bain of my life for months - in fact, I worked out that with all their calls, texts and the meat head's visit, it probably cost them more than I actually owe them!!Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free

For anyone reading this thread, when they call tell them you're willing to pay, ask them to hold whilst you find your card, this will get them all excited as they work out there commission  put the phone on the side for a few minutes, then go back to them and tell them your card is in the car ask them to hold a little longer :rotfl: keep them on hold for a few more minutes, then go back and inform them your cards have all been cancelled  :rotfl:
Notes will be added to your file "Do not call, time waster"
We can beat them at there own game!!!Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
