Terms and Conditions

These terms and conditions (the "Official Rules") are the rules of the Be a Pop Star for the Day in Hollywood! Competition (the "Competition").
The Competition begins 1st August, 2009 at 00:00:00 BST in the United Kingdom, and ends 31st December, 2009 at 23:59:59 GMT.
NO PURCHASE OR OTHER CONSIDERATION NECESSARY TO ENTER OR WIN THIS COMPETITION. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. PRIZE RESTRICTIONS APPLY.
1.ELIGIBILITY: The Competition is open to residents in the United Kingdom who are 18 years of age or older. Any entrant under the age of 18 must have the approval and permission of a parent or legal guardian. Any entrant under the age of 18 must be accompanied by a parent, legal guardian or other adult over the age of 25 on the trip to Hollywood should the entrant win the first prize. Employees, officers and directors of Sun-Maid Growers of California ("Promoter"), its licensors and prize suppliers, the administrator of the Competition, each of the foregoing entities' parent companies, subsidiaries, and affiliates, and Promoter's advertising and promotion agencies, and any other entity directly involved with the development or administration of the Competition (collectively, the "Competition Entities"), and members of their immediate families (spouses, parents, children, siblings and their spouses, regardless of where they live) and those living in the same household, are not eligible to enter or win. Participation in the Competition constitutes each entrant's full and unconditional agreement to these Official Rules and to Promoter's decisions, which are final and binding in all matters related to the Competition.
Entrant must provide all required information to be eligible to enter. By entering the draw each entrant hereby warrants that all personal information it submits is true, current and complete. Winning a prize is contingent on fulfilling all requirements set forth herein including, without limitation, answering the question set out on the entry form correctly. Promoter reserves the right to verify the eligibility of each entrant.
2.HOW TO ENTER: To enter the Competition, visit www.sunmaidcontest.com (the "Website") at any time from 1st August, 2009 at 00:00:00 BST in the United Kingdom until 31st December, 2009 at 23:59:59 GMT and register by entering your e-mail address, name, address, city, post code, phone number, and date of birth on the entry form and answering the question set out on the entry form.
Entries are limited to one (1) entry per person/email address, per day. A day is defined as a 24-hour period between 00:00:00 and 23:59:59. Any attempt by any entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void that entrant's entries. Multiple entrants are not permitted to share the same email address. Use of automated entries or programs is prohibited. Promoter accepts no responsibility for entries which are lost or delayed, or which are not received for any reason.
Entries will be attributed to the authorized account holder of the email address submitted during entry. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the registrant or entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Winning entrants may be required to provide Promoter with proof that the claimed winner is the authorized account holder of the email address associated with the winning entry, or forfeit the prize. Entries specifying an invalid, non-working, or inactive email address will be disqualified.
Entries become the property of Promoter and will not be returned or acknowledged, and Promoter will not verify receipt. All personal data relating to entrants will be used solely in accordance with all applicable laws, rules and regulations and the Promoter's privacy policy (see Privacy below). All entrants agree that Promoter and Promoter's service providers may use entrants' personal information submitted with entry for purposes of prize fulfillment and otherwise in connection with the administration of the Competition (including, without limitation, a list of the winners and their nearest city in each case) and for no other reason, unless entrant has expressly opted in to receiving future promotional email communications from Promoter.
3.COMPETITION DRAWING: The Competition Grand Prize winner and Runners-Up Prize winners will be selected in a random drawing to be conducted by an independent judge retained by Promoter for that purpose. The random drawing will take place on or about 29th January 2010 from among all eligible entries received. The independent judge's decisions are final and legally binding on all matters relating to the drawing. Odds of winning depend on the total number of eligible entries received.
In the event that a winning entrant is disqualified for any of the reasons set out in these Official Rules, an alternate entrant may be selected at the sole discretion of Promoter. Selection of a replacement shall be on the same random basis as for the disqualified winning entrant as set out in this section. For the avoidance of doubt, where a replacement winner is to be selected, winners of other prizes shall have no right to claim such replacement winner's prize.

4.PRIZES


GRAND PRIZE: One (1) Grand Prize will be available to be awarded, consisting of a 'Hannah Holiday to Hollywood'. Prize includes:

• Return flights for two adults and two children to Los Angeles
• fully inclusive car hire for the duration of your stay
• 4 nights accommodation at the Tower Beverly Hills Hotel, Los Angeles
• a recording studio experience for two people
• travel insurance.
• a SIGNED Hannah Montana record bag
• a set of four Hannah Montana dolls from Mattel
• a DVD of Hannah Montana The Movie

Terms & conditions specific to the Grand Prize:

• Travel is subject to availability at the discretion of the organiser. Flights must include a Saturday night stay in your destination. Departure airport used will be dependent on the direct availability from the winners nearest international airport.
• Driver must be over the age of 25 and have held a full clean drivers licence for a minimum of 2 years. Fully inclusive refers to unlimited mileage, collision damage waiver, theft protection, local taxes and airport fees. Driver must also hold a valid credit card (not debit card) with a minimum of £500 available for security deposit, which is refundable upon safe return of the vehicle.
• Hotel is classed as a 4 Star and is based on four people sharing a quad room with en suite bathroom on a room only basis. At least one guest must be over the age of 25.
• Winner and friend to enjoy a recording studio experience and take a CD of their song home. Exact details to be confirmed.
• All spending money and other expenses (including, without limitation, meals or personal expenses and upgrades) are the sole responsibility of the prize winner unless specifically stated.
• No sale, transfer or substitution of any of the items included in the Grand Prize will be permitted.

RUNNERS-UP PRIZES: There are 43 Runners-Up Prizes to be won:

• 20 x Hannah Montana The Movie DVDs (each a separate prize)
• 1 x set of Hannah Montana merchandise (one prize), including:
  • A Hannah Montana room makeover kit
  • A Hannah Montana sing along microphone
  • A Hannah Montana cushion
• 10 x Hannah Montana games for the Nintendo Wii (each a separate prize)
• 12 x Hannah Montana dolls from Mattel (each a separate prize)

General terms and conditions applicable to all prizes:

• Prizes are not transferable and no substitutions are allowed except, in the case of Runners-Up Prizes, in Promoter's sole discretion.
• No cash alternative.
• A limit of one (1) Competition prize per person/e-mail address will apply.
• Promoter reserves the right to substitute prize of equal or greater value if advertised prize (or portion of prize) is unavailable.
• Winners are responsible for any loss of prize or portion of prize after it has been delivered. Promoter will not replace any lost or stolen prizes.
• Any and all applicable federal, state and local taxes (including, without limitation, income and sales taxes) and all fees and expenses related to acceptance and use of the prizes not specifically stated herein are the sole responsibility of the winner.
• Only the number of prizes stated in these Official Rules are available to be won in this Competition.

5.WINNER NOTIFICATION AND VERIFICATION. An entrant is not a winner of any prize unless and until entrant's eligibility has been verified. Potential winners will be notified by telephone, email or mail on or about 5th February 2010. Return of any prize or prize notification as undeliverable may result in disqualification. If the Grand Prize winner does not accept the prize within the reasonable time period to be specified by Promoter, the potential winner will be disqualified.
6.GENERAL CONDITIONS: If, for any reason, the Competition is not capable of running as planned, including, without limitation, infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Promoter, Promoter may, in its sole discretion, void any suspect entries and cancel, modify or suspend the Competition or these Official Rules (or any portion thereof) without notice. Any changes will be posted on the Website where possible.
WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THIS COMPETITION OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Promoter's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Promoter reserves the right at its sole discretion to disqualify any individual entrant it finds to be attempting to tamper with or undermine the entry process, the Competition web site and/or the legitimate operation of the Competition; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.
7. LIABILITY
PROMOTER CANNOT ACCEPT ANY RESPONSIBILITY FOR ANY DAMAGE, LOSS, INJURY OR DISAPPOINTMENT SUFFERED BY ANY ENTRANT ENTERING THE COMPETITION OR AS A RESULT OF ACCEPTING ANY PRIZE. PROMOTER IS NOT RESPONSIBLE FOR ANY PROBLEMS OR TECHNICAL MALFUNCTION OF ANY COMPUTER ON-LINE SYSTEMS, SERVERS OR PROVIDERS, COMPUTER EQUIPMENT OR SOFTWARE RELATED TO OR RESULTING FROM PARTICIPATING IN THE COMPETITION. PROMOTER DOES NOT LIMIT OR EXCLUDE ITS LIABILITY WHERE TO DO SO WOULD BE CONTRARY TO LAW.
8. WINNERS LIST: The name of each prize winner and his or her nearest city shall be available for 90 days after winner verification on the Website.
9. PRIVACY: Information collected from entrants is subject to the Promoter's Privacy Policy.
10.JURISDICTION: English law applies and the exclusive jurisdiction of the courts of England and Wales shall prevail.
