6 year rule help please

Hi, i'll try me best to cut a long story short...lol
just over 10 yrs ago we had our first child. Up to our eyes in debt made HUGE mistake and had help (no help whatsoever) Eurodebt. Gave us some really bad advice, STOP paying all our debt and they'd sort it. Huh, weren't we gullible. Got into worse debt thanx to them.
6 years ago had dreadfull pregnancy again both myself and baby very ill. This poor baby now has autism and i have not worked since.
Still have not paid any of our debt and had no contact at all with most of them. What i would like to know now is can they still hound us for repayment through debt collectors and solicitors? If not what can we do about it now it's been over 6 years?

If you have made no payments, and you have not contacted the creditor for 6 years, then the debt is most likely to come under the statute barred legislation and, therefore, can not be pursued.
There is a lot of information on this site and I suggest that you enter 'Statute Barred' in the search facility at the top of the page.

This probably wont answer your question, but here's what's happened to me!!
I had a lovely suprise this morning when I opened a letter & it was a debt collection agency chasing me for a debt for £1050.00, from 1999!! I hadn't made a payment for years...through one thing or another.
I can totally empathise with you as my daugher is 3 & has cerebral palsy so I know how hard it is & that it is impossible to work.
The first thing I did today is got onto a solicitor.
He told me not to panic, advised that they can't take money off me that I dont have!
I will probably have to send them an expendature form to prove income & outgoings....but more than likely be able to get the interest reduced & pay £2 a week!
If you do get any correspondence off these people, then see a solicitor straight away, if you are in receipt of DLA for your daugher, you should get atleast 2 hours legal aid.

if you haven't made any payments or offers of payments for six years then the debts are statute barred and so the debt is unenforceable.
Your solicitor ought to know that.
Do not under any circumstances fill in a income and expenditure form and do not acknowledge the debt in any way whatsoever.
Unless of course you wish to repay the debts.0 -

Some of them have chased me and my hubby for his debts but we still aint paid any of them for a long time now. Most of them are for Lloyds TSB.0 -
If you believe that the debt is statute barred, you need to send the debt collector this letter.

Legally there is nothing the debt collector can do apart from asking you to pay, they can not go through the courts to enforce the payment if it is proven to be statute barred.I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!0
