I did it too...(yesterday at HCJ, London)

Hi everyone,

I am officially bankrupt from 14.34 pm yesterday. I went to Royal Courts of Justice to petition for BR in the morning. Here how it’s gone... (Maybe it will help somebody)
arrived at 8.45am to the court and waited until they opened the gate at 9am. Went through security gate and find the way to the fees office. I was really early there as the fees office is opening at 10 am same as the bankruptcy room at the Thomas More building. They opened exactly at 10 so there is no point getting in there too early.(by 9.45 am people started to make their way to the fees office so be there before that ) I handed in my papers for exemption(EX160), which been photocopied and stamped. After that I waited to pay for the fee. (I paid 345 pounds as I am receiving Income Support).
Together with the receipt and my petition form I headed to the TM building. Gone straight to the 2 nd floor and waited for one of the ladies to call me. (Only 2 ladies were working at the windows.) I handed in my 6.28 form and the receipt for the fees. She asked me if I understood what will happen after the order and I said yes. She made me swear on the Bible and checked my form. I signed it in front of her. I did not have to see a judge because of the simplicity of my case. She told me to get back at 14.30 and go to the 1st floor to receive my bankruptcy order. It was over in less than 10 minutes. By 10.31 I was out of the court building.:D
Because I had time on my hand I walked down to the Embankment and made some pictures of the boats and ships for my daughter. At 11 I caught the bus and went to look around on Oxford Street.
Shopped at Primark and 1 o’clock I headed back to the court. I arrived 2.15pm(with 2 paper shopping bags of baby clothes:o ). Waited with the others (maybe 25 of them) until 2.30pm.
They started to call out our names, mine were the 3rd. I received my bankruptcy order and a photocopy of my 6.28 form and also an information sheet about the OR appointment. If I will not hear anything from them in 2-3 working days, than I will have too call them. The phone appointment will be around 5-10 minutes. Hopefully everything will be ok with the OR. I would like to get it over with ASAP.
We will see...
Anyway:
- They only needed 1 copy of the form 6.28
-there is no point taking your bank statements and other papers because nobody wanted or had time to look at them.(and I took with me 2 years worth of them)
-Its a first come first serve system at HCJ, so arrive on time to be seen early.

Ps: I didn’t feel anything after my bankruptcy order, I was numb.:confused: It was like another day, say like queing at the local council office. I would like to feel that weight to be lifted. Maybe after the OR interview?????:confused:

  • My BR day was simple as well. I am on Income Support so my case was very similar to yours. Well done for making the big step, though. I was really scared but found that it was nothing to worry about at all. I did have to laugh when you said you showed back up at the court with bags of shopping. That's the sort of thing I'd do! :)
    I didn't feel anything after my day in court either other than relieved it was over and excited and proud of myself for doing it all on my own.
    Now I have to wait for my OR interview which is scheduled for next Friday at 10am. I am a little worried as I declared myself BR as unemployed - however, that evening, my new job started, but I couldn't include this in my income as I had no idea how much or how frequently I'd get paid, nor how it would affect my benefits. It turned out that my 11 hours last weekend earned me too much, even with the £20 lone parent disregard I earned £6.14 more than I get in IS so I'm not entitled to any IS this week. Hopefully, I will do less hours next week and bring myself back under the limit.

    Congratulations and well done! I have a feeling that going BR at the RCJ (I think you mean Royal Courts of Justice on the Aldwych?) is a slightly different experience than for those who go BR in the rest of the country - and you're right, they do only require 1 copy of your petition. If I were you I would keep your statements for when you speak to the OR.

    I'm surprised you didn't meet the OR's assistant today also - when i went Br there a year ago I (and some others on the forum) had to go and see the OR on the same day. They must have changed procedures recently.

    Anyway well done and here's to the future!

  • Thanks to everybody who helped me go through the bankruptcy process from the start til now. I couldn't have done it without the support of this forum , its members. I received so much I do not know where or how to begin with giving it back.

    I got my BR at the Royal Courts of Justice on the Aldwych, I call it High Court of Justice I thought it's means the same?!? If not then sorry for the confusion. I will keep my statement as you advised for the OR interview.And I didn't meet the OR's assistant yesterday because there were around 30-35 of us going bankrupt and it was only the individual debtor's petitions. They had a few people for creditor's petitions and again a few for companies. It was packed. Apparently my case were really simple. No assets, no car, receiving income support, and also no priority debt, only 18753 pounds of CC and loan debt. i have no idea if the others did meet up with the OR or not. I am really happy though to not to meet with anybody from OR office as I was really nervous after it for a while. Now its only the interview left..

    I haven't been there myself, but I had a client who went bankrupt a few years ago. Up to the point of bankruptcy, he looked a haunted man, ducking and diving like a boxer on the ropes, trying to get a few Pounds off Peter to pay Paul. After the bankruptcy, he was relaxed and looked 10 years younger. The worst had happened, and it wasn't too bad.

  • Well done. I've found your post really usefull, especially as I know it's something that will be happening to me in the future.
    Just wondering - did your bank account get frozen? Thats whats worry me at the moment, is when I go BR if they freeze my bank account, I'm not sure how i'll get paid from work.

    Neko it is some thing they seem to have started this year. I am assuming it is due to the sheer volume of people that are going BR, thet couldn't cope with every one trooping down there after they had been made BR.
