My experiences so far of making full and final offers.

Hi, some of you may have read other posts of mine/ours (my wife and I both use the username karma police) and will know that she has just gone bankrupt. I'm the other half of the partnership, so I thought I'd just offer up a few snippets of my current situation in the hope that it will help others.
As background, between us we owed about £43K, :eek: More or less split 1/2 and 1/2, and 90% of it in one or other name, just £2K was joint.
For various reasons, going BR was not an option for me, but was for my wife, so she's gone bankrupt as mentioned before to the tune of about 19K.
That left me taking on the joint £2K as well as my own £22K.
Currently I'm out of work, and have been for about 8 months, all the creditors know that, and all payments stopped in October, since then there have been hundreds of phone calls, and letters, but as I was unable to pay, they got no where.
Due to the generosity of a relative, I have been offered a lifeline of an interest free £10K or so to be used to offer my creditors in order to pay them off in full and final settlement, and allow me to start life again.
So far here are the results:
Barclayloan, owed about £11K, offered £5K, they've turned it down, onto round 2.
A & L Credit card. (MBNA) Balance £6K, offered £2K, Accepted.:j
Natwest CC, Owed just over £2K, initially offered £700 that was turned down, then offered £900, that's been turned down, Onto round 3.
Barclaycard, offered £700 on a £1600 debt, turned that down but said would accept £800, so they're sorted. :j
Barclays curent account OD, debt £1800, was offered £700, turned that down, but accepted £900, so they're sorted. :j
Lastly A & L current account OD, debt £600, offered about £200 IIRC, not heard back from them yet.
So three down, three to go, and so far about £9.5K of debt, sorted for £3.7K.

Overall I'm glad that we were pushed into a position of dealing with this, even if the reason for me stopping work (my mother in law's ill health) was very much unwanted.
Looking back we've paid approx £1000 a month for at least the last 5 years, just in repayments, that's £60K, and we ended up in more debt than we ever borrowed. Once you get to a certain point, it just doesn't work out anymore, debt just gets bigger and bigger.
Having to default on everything, and then move forwards from there has been very liberating. I can't wait to get the other three debts resolved, and then soon get back to work hopefully. The amount we'll owe my mother is small fry considering where we started, and it's interest free to boot, payable as and when we can afford it.:cool:
We're determined never to fall into the credit card trap again.

    I too am in the process of making full & final offers to creditors but unfortunately don't have the lump sum that you do. I am working like mad ( all hours literally) and am currently earning an extra £1000 a month that doesn't appear on my SOA as I'm self employed and its not guaranteed income.

    I'm working my way through my list of creditors and making offers one at a time, based on funds available that month.

    How did you negotiate with Barclaycard? They have failed to provide a CCA so I've offered 20% F&F. However, they just seem to ignore my letters, despite signing for them. At the moment I'm still making my reduced monthly payments but think I need to stop to make them take my offer seriously IYSWIM. Did you phone or write?

    After stopping payments in October to all creditors, we then sent an SOA to all and requested that interest was frozen, and offered a token gesture of £1 a month each. This was ignored by all but two creditors, most just started harassing us, and kept sending bills with ever threatening tones, and ever increasing debts. I February we made the decision that BR was the best route for my wife, and at that point got the CAB to start writing to my creditors offering F&F offers. Barclaycard (Mercers) called me earlier this evening, usual call, security questions, then asked if I could make a payment imediately to bring arrears into check, I said no, had they not rec'd my offer, he put me on hold, came back after a minute or two, apologised for delay, said that yes they had rec'd the offer of £700 on the debt (£1620) but would have to decline, although they would accept £810. I jumped at that imediately.

    From experience, I find you get better settlement deals when debts are sold on to DCA's as they buy them for pennies in the £ so 20% will make a tidy profit for them. Original Creditors would accept nothing less than 70%. Make sure you get it in writing before paying any money as they could sell the rest on and you could be chased for the rest at a later date. National Debtline website has a good letter you can use.

    I'd suggest wait until they sell the debts on and then make the offers. B/C/Mercers are one of my creditors and they sent a doorstep collector when I'd disputed the debt. Since then, May last year, they've gone quiet and accepted my payments.

    Don't speak to any of them on the phone, but deal in writing. I've since complained about harrassment and had my phone numbers removed from most of my creditors so they write to me now. They hate it, as they can't bully me and my phone is silent (apart from the calls I want!)
    Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)

    I think that's all very good advise, my wife's a little concerned that the two Barclays debts, CC and OD have been agreed over the phone today, We'll have to see what happens I guess.

    Don't accept it over the phone - get them to confirm in writing that it is in F&F and that your credit file will be marked as "satisfied" and that neither they, nor any associate or third party will chase full the remainder in the future. This is important. I've had my fingers burnt on this in the past.

    As I say, National Debtline website has a good template letter that you can use.

    To be honest, I am waiting for Barclayshark/Mercers to sell my debt on and then I will negotiate with a DCA.

    If they do ring back with an "offer" then don't accept it over the telephone. They will say that they can't put it in writing, but they can and will if you show you are in control.

    Didn't mean to scare your wife, so apologies for that, but I've been "had" in the past. I agreed an offer on the phone and 3 years later, got chased for the rest...that was years ago before I found this site. The collections agents get paid good commission for taking payments over the phone so will push for it. Be strong; you'll find if you keep it in writing there will be a bit of to'ing and fro'ing but bear with it.

    You could also mention that you have been lent this money by a family member/friend for the purposes of clearing this debt and if they don't wish to accept it within xx amount of days then the offer will be withdrawn and you will offer it to another creditor. Worked for me! What's a porky between "friends"...no doubt, they've told you a "porky" or two!

    well done so far ...one of my creditors gave me a great settlement offer the other day took 1/4 off balance ..got until end month to find the money

    I'd try and push for a bit more if I was you, mine have been keeling over for around 50%, MBNA went down for just 30%.:D

    Hi there i'm sorry to 'hijack' the thread a bit but I understand from the OP that they are not in a DMP? I was told by Payplan that it was not advisable to pay off some debts and not others as the other creditors could get nasty. Is this right? Obviously I am talking from a DMP point of view.
