Employer reducing my pay so all staff paid same.

Basically received letter about their intention to commence a consultation period regards changes to terms and conditions.
One area to be discussed is 'removal of pay anomalies' the other is change to enhanced sick pay.

I have been on this rate of pay for approx 5 yrs and others longer but out pay will be reduced by approx £2,500 p.a.Other are on the salary that they believe all should be on and a few who were recently employed are on a few grand less than the middle ground.
They state that all salaries be brought into line with the appropriate grade level for the job description.

I know that myself and other staff who this applies have the same job description as other staff but 5 yrs ago when i was first on this pay we had less responsibilty and pressure than we do now.
Do we have to agree to this change/ do we have a choice?
They have said they will give us a one off payment calculated at 50% of the difference between our current salary and the proposed salary. wow!

    You have a choice. Accept it or be deemed to have resigned.

    Despite popular belief terms and conditions and pay can be changed. The employer has started the required consultation but make no mistake, this isn't a two way process they have already decided what they are doing, this is to tick the box and get you on board.

    If you refuse to agree to the change they can simply issue a new contract and if you do not accept the contract you will be deemed to have resigned. If you carry on working regardless of whether you have signed the contract or not, you will have accepted the change.

    You can "work under protest" (theres a specific procedure you need to follow to do this) and try a tribunal claim but in the current economic climate, tribunals are determining that 10-15% cuts in salary do not these days constitute an unreasonable detriment and far better than being out of work so you would need legal advice before you go down this route.

  • Hi thanks for response. i did have my doubts given the financial climate but this is not why they are doing it. Some staff are being increased in pay who have only started working for the company in past 6 months on approx £18,500 others are on the middle ground and those of us who have worked there alot longer above that.
