Has anyone had prmised after 31 dec letter from HMRC?

Options
Hi folks,

Just wondering has anyone had the promised after 31 dec letter from the tax people about the 098/09 and 09/10 underpayments that they had contacted us earlier about? So far this year I have had nothing.

John

There's been no activity on here to suggest that's happened. And the decision to go back and unearth underpayments for 07/08 (first P800s in the last couple of days judging by recent threads) - may have impacted the timetable?

HMRC don't appear to have updated the data on their Homepage - which still reflects 'after 31st Dec'. But ignores 07-08.

  • Letter demanding payment by 22nd Feb received today!

The rather large amount is split between 08/09 and 09/10 due to incorrect tax code being used.

Two letters have been sent (first reply didn't answer the original letter) asking when the coding notice (that employer didn't apply) was sent and when. One issue is changed employers during 09 so a bit complicated. I should note letters sent recorded delivery (but not showing as delivered in track and trace but obviusly at least 1st was was) and reply took about 4 weeks.

No formal appeal has been sent (but I did link to Guardian draft letters) as was waiting for the above info to see if employer was at fault.

    Questions to all:
    - Has anybody successfully appealed? If so what route was used?
    - Has anybody reached a settlement? If so what sort of terms?
    - Anybody taken useful professional advice?

I think this forum could be vital to allow people to share experiences on what HMRC are thinking and willing to do.

    Replies really appreciated!

There are countless threads on this subject. You just need to work your way back over the last few pages on this forum?

................ if you want more specific advice then you need to post more detail from the P800s / your P60s?

  • Mike - thanks for reply but looking for some thoughts on those who have managed to appeal and/or have amounts written off or made agreement to repay less. I think it is recent that demands have actually been sent. (just statments until now?)

With a £15k bill looking for some (possibly hopeful) feedback!

There's a thread here devoted (mainly) to that :-

Broadly there are 2 avenues. Asking for ESC A19 to be invoked if you consider HMRC had the info and failed to act on it. Or - that your employer was negligent with operation of PAYE ..... and should therefore pay the bill.

Both of those are quite well set out by HMRC on their Homepage. You will need to read outwards on all the links :-
