Hi all,
I've been lurking on the forum for quite some time and taking notes of all the useful pieces of advice but not had the courage to post. So finally here it goes : (apologies if I ramble on a bit
) My personal circumstances are that I am going to have to go bankrupt within the next few months or so, depending on how long I can eke out my savings. To cut a long story short, my partner had a suspected stroke in April and has since lost his job. We have a deficit in our incomings and outgoings before any debt repayments (265.00) as he is only entitled to incapacity benefit and I owe 22,000 in unsecured debt. (due to ill health on my part, redundancy on his part and now his health issues).
I have sought advice from a financial person from the Teacher's Support Network who advised that my best option would be to file for bankruptcy after having gone through a debt management option offering token payments. However I'm having problems with GE Money and GE Capital Bank who keep phoning at all times of the day and night and to be honest with caring for my partner on top of everything else I'm starting to lose patience. I saw on here a while ago a template letter to creditors about harassment and although I have been through the threads I can't seem to find it. Would anyone mind please pointing me in the right direction?
Thanks for reading (and please go easy on me
) ),

State in writing via recorded delivery that all further contact regarding the debts must be conducted in writing only.
If the calls continue after this then send something along these lines.Dear Sir/Madam,
Ref. 1234567890
Despite my letters regarding ANY communication from your company, which stated that I require ALL communications in writing, your telephone calls continue.
This behaviour constitutes harassment; the letters stated quite clearly to you that I require ALL communications in writing for future Court use. Do not telephone me again - remove any telephone numbers you hold for me from your systems.
Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office. For your information note that ALL telephone calls are taped.
This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint, containing copies of all correspondence including yours, has now been submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
Communicate in writing and ONLY in writing, your telephone calls will NOT be answered.
HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.
I trust that I have made myself understood on this matter,
Yours faithfully,

That letter is a follow up to a first request for communication in writing only.
If this is the first request you are sending you might want to edit it a bit first to reflect this.
Good luck.
PS. You might find it useful to post on the Debt-Free Wannabe forum regarding general non-bankruptcy related issues as well. Like dealing with creditors etc. There is a wealth of experience there in addition to this forum.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

I have already written to them to ask for communication to be in writing but they have ignored it.
Thanks

In case anyone needs it, the initial letter to stop phone calls is this one.
Dear Sir / Madam,
Re accounts ref
I am writing to you to inform that I request all communications to me in writing. I do not want any further telephone calls made to me.
To continue to contact me by telephone after I have requested you not to constitutes harassment. I require all future communications in writing for future Court use. Do not telephone me again – remove any telephone numbers you hold for me from your systems.
