2nd year in DMP

im coming up to my 2nd year on my DMP for those who have gone through can they please tell me what happens now do the creditors start puttin the interest on or not. do the phone calls start again. much advise would be apprecaited. thanks in advance

  • Hello there I'm quite new to posting here I have been on a DMP since the end of 2006 and my creditors have been very good in the fact they have never added on any interest and charges up till now I still have quite away to go till I'm debt free.But I will get there. Are you doing your DMP yourself? Or are you doing in through one of the charities? Like Payplan or theCCCS.I'm doing mine on my own and it's been plain sailing so far.:D

  • I'm in a dmp with payplan and when I finished my first year I had an annual review with them where we went over my finances again - they just asked if anything had changed, had I had a payrise, could I afford to pay any more to them etc etc.

    It was all pretty straightforward and nothing to worry about. None of my creditors have added interest and I never got any hassle from them either. Payplan dealt with it all and luckily, they all agreed to my payments.

  • Im into my 2nd year of a DMP with CCCS...

    Ive just started to get hassle again from Lloyds TBS..they have removed the O/D from my over drawn account added yet more charges so now i owe more than i did origanally...They send me letters saying our agreement has come to an end, and are threatening to send people round!!! the letter arrived last week..i was distraut!!! I have spoken to about 5 different people within lloyds collections, every time a different answer, one stupid *** even said the bailif would come.... if it hadnt been for the help from some wonderfuly helpful people on this site, i wouldnt be here now!!!

    I recieved a letter yesterday from Lloyds saying they have given me a temp O/D and charging me 18.9% interest... nice of them!!

    Ive written back to them asking for them to please suspend interest as all my other creditors are doing so, and to refund me the unfair charges as it is putting me into finacial hardship.. and that my payment soon wouldnt even cover the interest and charges applied to the account...

    I also pointed out.. OFT guidelines..

    ie..psycological harassment...
    not dealing with CCCS and contacting me direct...

    pressuring me to pay in large amounts when they know i cannot afford them... ( I cut and paste the proper wording from the OFT website..but it wont let me do that on this board for some reason... but you get my gist)

    lloyds are aware i have a mental illness and their constant badgering is making me very ill..i have made a formal complaint...

    None of the other creditors have even contacted me since i started my plan...so hopefully lloyds settle down and in just over 5yrs...i'll be dept free.... Im living for that day...

    Ive not missed a DMP payment, and have upt the payment this year by £55.. we currently pay CCCS £455.. our debt is £28000. but it was £33000 so its going in the right direction. ..

    Its not been easy... but hopefully lloyds will start to play ball.... fingers crossed

  • OMG Pauline that's terrible. Some of these companies just don't know where to stop.

    I must admit before my 1 yr annual review I was hassled by Northern Rock, they said that my agreement with them only lasted 9 months. They tried to get me to agree to paying them extra - outside my dmp. But I contacted Payplan, told them exactly what was happening and they dealt with it for me.

    When I first started my dmp (just before it kicked in) I was getting terrible hassle from RBS, I wrote a letter (I think the template was on here somewhere) about harrassment and got a letter back from them within a week apologising profusely, and haven't heard a dickie bird direct from them since.

    So hopefully your letter to Lloyds will help your situation.

  • You tend to have a yearly review with whoever is arranging your DMP. I'm with CCCS and they are brilliant - its so easy to update, just a quick phonecall. They will get in touch with you by letter to arrange this (if thats who you have your DMP with).

    Touch wood and fingers crossed, I haven't had a letter or a phonecall from any of my creditors since about 2 months after my DMP started.

  • CCCs said i should formally complain..which i did...

    They told me to ignore the letters...unless its a default notice or a letter from the court...

    Lloyds said CCCS hadnt contacted them..and they didnt have any details of my situation... they even told me to get CCCS to ring them... this is the point i formally complained about... Lloyds wont speak to a 3rd party over the phone... so they mislead me!!! CCCS said they do this all the time, fob you off.

    I pointed out Lloyds have access to my SOA through CCCS 24/7 so they are very aware i cannot afford to pay them more.... they werent interested....

    I think its about time there was a law passed to stop this type of thing happening... if your paying them back they shouldnt be allowed to hassle and threaten you... I hope this merger with halifax doesnt go through..coz my safe account is with halifax..and i cant cope with having to change banks again....

    I am writing to express my serious concerns regarding the telephone calls that I have received from your company.

    I am now formally requesting that all further correspondence be made in writing only.

    I demand that these phone calls stop immediately. I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts.

    If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.

    Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

    You will be deemed to have been served notice of my request and I will deem it served by (date 7 days after date of letter) and I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.
