    Being taken to court by VCS for parking in a customer only car park on 27/04/15. On my original statement I thought the time of the alleged offence was at 7.20am, however on receiving all details from VCS it now seems the time of the offence was around 20.30. This makes my argument seem stupid. VCS did not tell me this during mediation and have obviously thought because of this they have a good case. Can I try a different line of defence? Can I bring new evidence to the court?
    Their claim is that parking is for "Strictly Customer Parking Only" and the signage says just that, no more. I was wondering if I get statements or evidence from all the retail units in the estate (there's only 4 retail shops) could I claim that I am a customer and therefore had a right to park there? The units are Screwfix (i Have an account) Howdens Joinery ( can get a letter saying I'm a customer, a garage that we use for our car repairs and B and Q where I have a loyalty card.Any help gratefully appreciated.

    Some B and Q's close at 21.00 pm. It may be that even if the store near to where you parked now closes at 20.00 pm they might have been open until 21.00 pm in 2015. VCS will try it on. You are not dealing with John Lewis.

    Also stores close the doors at closing time but there are still people in the store often still browsing and there are sometimes queues at the tills. If there was a query at the till it may have been 20.20 PM before you left the store. Which B and Q store was it?

    Just a quick post to thank everyone for the advice given. The case was thrown out, as VCS sent one solicitor for 3 cases all listed at the same time. The judge said he saw no reason why him or I should wait and struck it out.

    I received a time of 10am to appear at Doncaster Magistrates Court. On arrival looked at the list said there were 3 cases all with VCS all for 10am at 3 separate courts. One couple said they really wanted to go first as they had to get to work so approached the clerk, they went first at 10am. I was feeling a bit down as to why they went first, but then after 10 mins judge asked to see me. He explained that though there were 3 cases VCS had only sent one representative. He said he wasn't happy that either I or him should be waiting around and wouldn't allow cross courting, so that if it is was ok with me he would "strike the case". He said that there was a slight risk that VCS could start the case again but doubted this personally. Thanks again everyone.

    Did you get your costs of attending - half days loss of leave etc, as normal?

    A wins a win
    No chance theyll appeal, as then the court can simply sanction them for wasted costs of the hearing anyway, say 500 in costs to the court...

    I can only guess but I imagine the first one was thrown out. If the issues were broadly similar in all 3 cases that would enable the judge to chuck out the other 2 without a hearing.

    The judge doesnt even have to do that - if theyre all scheduled a th same time they can summarily stirke out the 2 claims they want and hear another. The outcome of the heard one has no bearing on why the other two were struck at all.

    Yep, and each judge will have been told there was only ONE VCS rep for the three cases, which obv VCS KNEW were all listed at the same time, and so the other two judges can just decided to kick out the 2 that were left - which is what they did.

    Great news. Well done.

    I wonder if being Doncaster they sent one of their own but I think that they use rent a legal even in Sheffield.

    VCS are losing most of these historic claims that are defended. I don't think that there has been one of their historic claims that have been lost on this forum yet. Discontinued but not lost.
