    Hi My brother and I are sole beneficiaries of my mothers (still alive) estate. Basically just the house.
    We have recently found that he has cancer and maybe only have app 6 months to live.
    His partner of about 15 years now wants them to get married before he dies.
    My question is if my brother dies before my mother, would his wife be entitled to half my mothers estate or would I be the sole beneficiary.

    His portion of 50% to be divided equally among his children.
    0% to his wife/partner.

    Its known as the Section 33 rule.

    if you read carefully you may notice there are Annotations(Fs) at various places.

    they are changes that have been made by subsequent acts
    At the bottom are the links to what they were.

    If you follow them you can build the history.

    The current wording is from 1982 the original is quite different.
