    We sent our leaking tent back to Go Outdoors, who confirmed itís leaking, canít be repaired and they offered to exchange it. That model has been discontinued and we canít find a suitable alternative on their website. So they offered us a credit note.

    We asked for refund instead but they refused. They insist they are within their rights to only offer a credit note.

    Is that correct? We returned the tent within their 1 year tent guarantee period.

    As it appears that you are using their guarantee, then if it says in the terms of that guarantee that a credit note is acceptable, then it is ok.

    However, if you are seeking a remedy under you statutory rights as a consumer, then different criteria apply.

    After six months from sale the Consumer Rights Act says that it is for the Consumer to show that the product was faulty at the time of the sale. If it is deemed not to conform to contract at the time of sale, then if the seller offers a refund it can be reduced to take account of the use you have had.

    So to summarise, either accept a credit note for the full value (if their guarantee terms allow for that), or enforce your statutory rights and possibly get a reduced refund.
