    Hi,
    I'm getting a replacement phone through my mobile insurance, but I've asked for my old one back as apart from the camera it's working fine, and I'd like to have it as a backup. I've been told by the insurance company that my old phone is now the property of the underwriters. Does anyone know if this is correct (I couldn't see any wording relating to this in the policy of T&Cs), or can I demand my old phone back?

    No you can't. If they've paid out under the terms of the policy for a replacement, then it becomes their property. Just the same as if you wrote off your car.

    The insurance company will refurbish your phone and resell it to recoup some of their costs.
